SWARTZ - � �... � WHEREAS, a request has been received from Bruce A. Swartz, owner of property abutting thereon, requesting the vacation by the City Council of that alley in the City of Decatur, Illinois described as: Beginning on the West right-of-way line of U.S. Route 36 and the North line of Lot 10 of East View Subdivision as per�lai recos ued in Book 300, Page 23 of the records in the Recorder's Office of Macon County, Illinois, thence West to the East right-of-way line of 22nd Street, thence North along the East right-of-way line of North 22nd Street to the South line of Lot 4 of said Addition, . thence East to the West right-of-way line of U.S. Route 36, thence Southeasterly to the point of beginning; and, WHEREAS, said alley is no longer useful to the public or to the City or to the owner of the property abutting thereon as an alley; and, WHEREAS, the public interest will be subserved by vacating said alley and the public will be relieved from the further burden and responsibility of maintaining the same. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF TI� CITY OF DECATUR, II.LINOIS: Section l. That the above described alley be, and the same is hereby, vacated as a public alley inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation, said alley being shown on the plat thereof hereto attached and hereby made a part hereof. Section 2. That there is hereby reserved in, over, along and under the above-described alley to the City of Decatur, Illinois, and to the public and to those utilities and companies as the case may be owning public service facilities, mains, sewers, telephone and electric or other public utilities, such property, rights of way and easements as are or may be necessary or desirable for continuing public service by means of such facilities and for the maintenance, renewal and reconstruction thereof with the right of ingress and egress for such purposes.
