That the benefits which will be accrued to the owner of abutting property by <br /> reason of the vacation aforesaid is determined to be, in the judgment of the Council, equal to the <br /> sum of Five Thousand Five Hundred Dollars ($5,500.00), except as modified by paragraph 4 <br /> hereof. <br /> Section 4. That the vacation herein provided for is made upon the express condition that <br /> there shall be paid to the City of Decatur, Illinois, by or on behalf of the owner of the property <br /> abutting upon said alley vacated hereby the sum of $5,500 as compensation for the benefits <br /> determined as above set out herein upon the payment whereof such vacation shall become <br /> effective; provided that, if such property owner provides the City with an appraisal of said alley <br /> acceptable to the City Manager not later than 7uly 31, 1995, and said appraisal finds a fair market <br /> value of less than $5,500, said Manager shall rebate to such owner one-half(1/2) of the difference <br /> between $5,500 and said appraisal. <br /> PRESENTED, PASSED, APPROVED AND RECORDED this 26th day of 7une, 1995. <br /> TE .
