3. USE <br /> The Burn Trainer shall be used to teach students in RCC's Fire Science Program in the <br /> handling of fire and emergency situations. These situations will include but are not <br /> limited to rescue and "live" fire training. It is understood by the parties that this trainer is <br /> designed to contain controlled fires that are to be studied by students and extinguished. <br /> The CITY agrees to provide RCC staff and students access to the area at reasonable <br /> times, including unlocking the gate of the fence surrounding the premises or making a � <br /> key available. The parties agree that RCC will have first priority in using the Burn <br /> Trainer. The CITY will be able to use the Burn Trainer at no cost at any time when it <br /> will not conflict with activities planned or scheduled by RCC. <br /> Other fire fighting agencies within RCC's district may use the Burn Trainer when not <br /> scheduled by RCC or the CITY. Such agencies must request permission from RCC two <br /> weeks in advance of the intended date of use, sha11 provide a certificate of insurance, and <br /> shall show that participants have a legitimate purpose and an instructor certified by the <br /> State Fire Marshall. RCC will provide a Use Agreement stipulating a rental charge, if <br /> any, and the responsibilities of the parties. The Use Agreement must be signed by the <br /> Fire Chief of the renting Fire Department and RCC's Dean of OccupationaUTechnical <br /> Career Programs or his designated representative. <br /> RCC will maintain a schedule for the use of the Burn Trainer through the office of the <br /> Dean of Occupational/Technical Career Programs. RCC will keep the CITY reasonably <br /> informed about the schedule by submitting a written schedule to the CITY at least one <br /> week prior to use. <br /> 4. OWNERSHIP AND MAINTENANCE <br /> RCC shall retain ownership of the Burn Trainer. Other equipment used by any party <br /> during the training exercises will be brought in as needed and removed when a particular <br /> training session is complete. <br /> Normal and necessary maintenance of the Burn Trainer will be the responsibility of RCC. <br /> If the Burn Trainer is found not to be in a proper and safe working condition, it shall be <br /> reported immediately to the Dean of the OccupationaUTechnical Cazeer Programs. <br /> In the event that the Burn Trainer is damaged beyond normal wear and tear, the party <br /> using the equipment at the time the damage occurs shall be responsible to return the <br /> equipment to a proper and safe working condition to the satisfaction of RCC. <br /> 5. TERMINATION <br /> Either party may terminate this agreement by giving written notice no later than April 1 <br /> for the subsequent academic year beginning in August.
