III LEAF COLLECTION SERVICE 3.1 During the term of this agreement, but only during the collection periods, SUBURBAN shall perform curbside leaf vacuuming and disposal at a11 residential premises in the City of Decatur as provided herein. 3.2 During each collection period, SUBURBAN shall provide leaf vacuuming at each residential premises not less than seven(7)times during the autumn collection period and two (2) times during the spring collection period; provided that, failure to provide seven (7) leaf vacuumings at any premises during the autumn collection period due to snow or ice shall not be considered a breach of this agreement. SUBURBAN shall be responsible for vacuuming substantially all of the leaves properly deposited at each premises, without limitation as to volume. 3.3 SUBURBAN shall provide the CTTY with a schedule showing the dates for leaf vacuuming at each premises, and must then follow said schedule. Such schedule shall establish a specific day of the week for leaf vacuuming in each block of the City, and shall indicate any weeks in which there shall be no leaf vacuuming. Such schedule must be submitted to the CITY on or before August 15, 2000, and on or before August 1 of each year thereafter, and may not be changed thereafter for that year without the approval of the City Manager. It shall be the duty of the CITY to provide notice of such schedule; provided that, SUBURBAN shall give notice of any change to said schedule by publishing the same in a local newspaper of general circulation. 3.4 If SUBURBAN is unable to provide leaf vacuuming service to a premises on a scheduled day, SUBURBAN must provide such service thereto prior to noon on the following day. SUBURBAN shall attempt to provide telephone notice to the premises on the day service was missed, providing information regarding when leaf vacuuming will be provided. 3.5 SUBURBAN shall not perform leaf vacuuming under the terms of this agreement before 7:00 AM or after 7:00 PM on any day. 3.6 SUBURBAN sha11 provide traffic control during leaf vacuuming operations, as approved by the CITY'S Police and Engineering and Infrastructure Departments. 3.7 SUBURBAN shall provide all personnel,materials, tools and vehicles to perform its duties and obligarions hereunder. IV PAYMENT 4.1 The CITY shall pay SUBURBAN the sum of FOUR HUNDRED THREE THOUSAND TWO HLTNDRED DOLLARS ($403,200.00) for each yeaz during the term hereof. This sum shall be paid in equal monthly installments, with each installment payable on or before the tenth (lOth) day after the month for which it is due, with the final installment due on September 30, 2005. 2
