AGREEMENT <br /> This Agreement made this 1 st day of May, 2000, by and between the City of <br /> Decatur, Illinois ("City"), a municipal corparation, and the Decatur Park District <br /> ("District"). <br /> Whereas, the City owns and operates an 800 MHz Radio System(the"System") <br /> for use in dispatching law enforcement and fire and rescue services by various public <br /> agencies, including the City and the District; and, <br /> Whereas, the District wishes to have access to the System such that those radios <br /> used by personnel of the Decatur Park District Rangers can communicate with the <br /> System and with other users of the System; and, <br /> Whereas, the City is willing to grant the Decatur Park District Rangers such <br /> access, on the terms and conditions set out herein. <br /> NOW, THEREFORE, for and in consideration of the provisions hereof,the City <br /> and the District agree as follows: <br /> 1. The System is hereby defined as that 800 MHZ radio system owned and <br /> operated by the City,the dispatch center for which is located in the Law Enforcement <br /> Center, 333 S. Franklin Street, and includes but is not limited to all towers, transmitters, <br /> receivers, controllers, microwave transmitters/receivers, computers, software and <br /> firmware, electronic circuit boards and all other components located in any part of the <br /> System, as well as the power supply thereto and the physical facilities supporting or <br /> housing the same. The System does not include portable or mobile radio transmitters/ <br /> receivers owned by any entity other than the City. <br /> 2. Subject to compliance with all of the terms and conditions of this Agreement, <br /> the City hereby grants to the Decatur Park District Rangers access to the System for <br /> those radios used by the Decatur Park District Rangers. The District shall not allow <br /> the use of said radios by any other department of the District or by any non-law <br /> enforcement personnel, except with the written approval of the City. <br /> 3. (a) For access to the System as herein provided, the District sha.11 pay to the <br /> City a monthly fee of Eight Dollars ($8.00) per radio which has been programmed to be <br /> used on the System regardless of the level of use or activity of tha.t radio.
