This Amendment No. 1 to an Agreement dated March 17. 1997, between the State of Iliinois, Department of Transportation, Division of Public Transportation, and the City of Decatur, Illinois, is made and entered into by and between the parties thereto. In consideration of the mutual covenants contained herein and in such Agreement, the Parties agree as follows: To amend the "State/Federal Capital Assistance Grant Agreement" by amending: 1. ITEM 2 - THE PROJECT to deiete 11.12.01 - Purchase of up to three heavy-duty buses and add the following: 11 12 02a - Purchase three heavv-duty buses � 11.12.02b - Contingencv ; 11 12 02c - Purchase two heavy-duty buses I 11 12 02d - Purchase two heavx-duty buses i, 2. ITEM 3 -AMOUNT OF GRANT to increase the Net Project Cost from $655.050 to $1.925.000. 3. ITEM 5 - REVERSION OF GRANT FUNDS to extend the grant expiration date from January 1. 2000 to,�anuary 1. 2002. 4. To amend the "State/Federal Capital Assistance Grant Agreement" by deleting the Agreement dated March 17. 1997, in its entirety, and replacing it with the following Agreement (REV. 05.25.99) along with its Appendices executed on the date below. This Contract No. 2493 (hereinafter referred to as "Agreement") is made by and between the Illinois Department of Transportation, Division of Public Transportation, (hereinafter referred to as the "State" or"Department") and the City of Decatur, Illinois, (hereinafter referred to as the "Grantee," which term shall include its successors and assigns). WHEREAS, the State has received a Federal Transit Administration mass transportation capital Section 5309 grant, for Project Nos. IL-03-0190 and IL-03-0199, for the purpose of partially funding eligible capital grant projects, and WHEREAS, the Grantee is undertaking a mass transportation capital project (the "Project") as described in the Grantee's final approved application which is incorporated herein by reference as Exhibit "A" hereto; and � WHEREAS, the Grantee is an eligible grant recipient and the Project is an eligible mass transportation project under the provisions of the Civil Administrative Code of Illinois (20 ILCS 2705/49, et seq.), and the General Obligation Bond Act (30 ILCS 330/1 et seq.) (hereinafter collectively referred to as the "Acts"); and WHEREAS, the Grantee has made application to the Department for State and federal aid for the Project in accordance with one or both of the Acts and pursuant to the procedures established by the Department; and WHEREAS, the Grantee's final application, including subsequent submittals, information, and documentation, as provided by the Grantee in support thereof, has been approved by the - Department; State/Federal Capital Grant page 4
