, + <br /> . . <br /> This Amendment No. 1 to an Agreement dated March 17. 1997, between the State of Iliinois, <br /> Department of Transportation, Division of Public Transportation, and the City of Decatur, Illinois, <br /> is made and entered into by and between the parties thereto. <br /> In consideration of the mutual covenants contained herein and in such Agreement, the Parties <br /> agree as follows: <br /> To amend the "State/Federal Capital Assistance Grant Agreement" by amending: <br /> 1. ITEM 2 - THE PROJECT to deiete 11.12.01 - Purchase of up to three heavy-duty buses <br /> and add the following: <br /> 11 12 02a - Purchase three heavv-duty buses <br />� 11.12.02b - Contingencv ; <br /> 11 12 02c - Purchase two heavy-duty buses I <br /> 11 12 02d - Purchase two heavx-duty buses i, <br /> 2. ITEM 3 -AMOUNT OF GRANT to increase the Net Project Cost from $655.050 to <br /> $1.925.000. <br /> 3. ITEM 5 - REVERSION OF GRANT FUNDS to extend the grant expiration date from <br /> January 1. 2000 to,�anuary 1. 2002. <br /> 4. To amend the "State/Federal Capital Assistance Grant Agreement" by deleting the <br /> Agreement dated March 17. 1997, in its entirety, and replacing it with the following <br /> Agreement (REV. 05.25.99) along with its Appendices executed on the date <br /> below. <br /> This Contract No. 2493 (hereinafter referred to as "Agreement") is made by and between the <br /> Illinois Department of Transportation, Division of Public Transportation, (hereinafter referred to <br /> as the "State" or"Department") and the City of Decatur, Illinois, (hereinafter referred to as the <br /> "Grantee," which term shall include its successors and assigns). <br /> WHEREAS, the State has received a Federal Transit Administration mass transportation capital <br /> Section 5309 grant, for Project Nos. IL-03-0190 and IL-03-0199, for the purpose of partially <br /> funding eligible capital grant projects, and <br /> WHEREAS, the Grantee is undertaking a mass transportation capital project (the "Project") as <br /> described in the Grantee's final approved application which is incorporated herein by reference <br /> as Exhibit "A" hereto; and � <br /> WHEREAS, the Grantee is an eligible grant recipient and the Project is an eligible mass <br /> transportation project under the provisions of the Civil Administrative Code of Illinois (20 ILCS <br /> 2705/49, et seq.), and the General Obligation Bond Act (30 ILCS 330/1 et seq.) (hereinafter <br /> collectively referred to as the "Acts"); and <br /> WHEREAS, the Grantee has made application to the Department for State and federal aid for <br /> the Project in accordance with one or both of the Acts and pursuant to the procedures <br /> established by the Department; and <br /> WHEREAS, the Grantee's final application, including subsequent submittals, information, and <br /> documentation, as provided by the Grantee in support thereof, has been approved by the <br /> - Department; <br /> State/Federal Capital Grant page 4 <br />
