That should the CITY require changes to the contract documents after they have been <br /> completed in accordance with the contract or as a result of policy changes by the CITY <br /> during the time work is underway the CITY shall pay the ENGINEEER for such extra work in <br /> accordance with Section 2 of THE CITY AGREES. <br /> It is understood that "changes" as used in this section means basic changes in location or <br />� design and that the provisions of this section shall in no way relieve the ENGINEER of his <br /> responsibility to prepare a complete and adequate set of documents satisfactory to the <br /> CITY. <br /> 6. That he will save harmless the CITY, any other govemmental agency, or any representative <br /> of the CITY of any other govemmental agency from all claims and liabilities due to activities <br /> of himself, his subcontractors, his agents, or his employees and that he will carry insurance <br />' to provide such protection. <br /> 7. That he will comply with all applicable Federal Statutes, State of Illinois Statutes, and local <br /> laws or ordinances of the CITY. <br /> 8. That none of the services to be fumished by the ENGINEER shall be sublet, assigned, or <br /> transferred to any other party or parties without written consent of the CITY. <br /> 9. That all plans, specifications, estimates, plats, and other documents fumished to the CITY <br /> by the ENGINEER in accordance with this AGREEMENT shall be endorsed by him and shall <br /> show his professional seal where such is required by law. <br /> 10.That a ment b the ITY in accordance with Sections 3 and 4 of THE CITY AGREES will <br /> p y C <br /> Y <br /> be considered as payment in full for all services rendered in accordance with this <br /> AGREEMENT. <br /> 11.That he is qualified technically and is entirely conversant with the design standards and <br /> policies applicable to the PROJECT; and that he has sufficient, properly trained, organized, <br /> and experienced personnel to perform the services enumerated herein. <br /> 12.That work shall be commenced by the ENGINEER within ten (10) days after City Council <br /> approval of the PROJECT. <br /> 13.This AGREEMENT may be terminated by the CITY upon giving 15 days notice in writing to <br /> the ENGINEER at his last known post office address. Upon such termination, the <br /> ENGINEER shall cause to be delivered to the CITY all drawings, specifications, partial and <br />' completed estimates, and data, if any, from soil survey and sub-surface investigations with <br /> the understanding that all such material becomes the property of the CITY. The ENGINEER <br /> shall be paid for any services completed and any services partially completed in accordance <br /> with Section 3 of THE CITY AGREES. <br /> -2 - <br />
