• ,. <br /> , ,, , � <br /> AGREEMENT <br /> For and in consideration of the promises, covenants, agreements and conditions <br /> hereinafter set forth to be performed, kept and met by the respective parties hereto, this <br /> Agreement is made by and between THE CITY OF DECATUR, ILLINOIS, hereinafter referred <br /> to as LESSOR, and MACON RESOURCES, INC., a not for profit corporation, hereinafter <br /> referred to as the LESSEE, as follows: <br /> 1. This Agreement shall become and be effective as of November 1, 1999, and <br /> shall continue in effect until Apri130, 2000; thereafter, the Agreement shall <br /> continue in effect from year to year, or until one party or the other shall <br /> give notice of its intention and desire to terminate the same, not less than <br /> sixty (60) days prior to the end of each six-month period (i.e.) by <br /> February 29, 2000, or August 31, 2000, and thereafter. <br /> 2. Commencing with the first day of the term of the Agreement and continuing <br /> through the duration thereof,the LESSOR agrees to lease one (1) 1979 <br /> Flxible, Model 870, transit coach to the LESSEE for transportation of its <br /> clients. <br /> 3. The transit coach shall be leased for approximately three (3) hours daily, <br /> Monday through Friday, for a minimum of 240 days annually. <br /> 4. LESSEE'S OBLIGATIONS: The LESSEE is leasing the vehicle so that <br /> it may transport its clients and establish standard arrival and departure times <br /> for those individuals served by Macon Resources, Inc.'s Developmental <br /> Training Program. The LESSEE shall be responsible for the following: <br /> A. The LESSEE shall hire, train and oversee the operators and <br /> attendants who will be assigned to drive the leased vehicle. <br /> B. Such operators hire to operate the leased coach shall be <br /> properly licensed and must meet all applicable regulations <br /> for a coach operator. . <br /> C. The LESSEE shall notify the LESSOR of the exact times and <br /> the dates that the vehicle will be needed. If there is any change <br /> in such times and dates, the LESSEE shall give the LESSOR <br /> at least 24 hours advance notice except in the case of <br /> emergency weather conditions. <br />
