PRELIMINARY TRANSPORTATION PLANNING AND ENGINEERING <br /> SERVICES AGREEMENT <br /> L ��fl �I <br /> THIS AGREEMENT,made and entered into this�day of� I�11�1999,by and between the � <br /> City of Decatur, Illinois, a municipal corporation, heremafter referred to as the "City", and Bucher, <br /> Willis & Ratliff Corporation, with offices located at 7920 Ward Paxkway, Kansas City, Missouri, <br /> hereinafter referred to as the "Consultant", <br /> WITNES SETH: <br /> WHEREAS, the City desires to have the Consultant to provide transportation planning and <br /> engineering training services for the City's planning staff, hereinafter referred to as the "Project". <br /> WHEREAS, the City has selected the Consultant to perform their services as described herein. <br /> NOW, THEREFORE, the City and the Consultant in consideration of their mutual covenants herein <br /> agree in matters pertaining to the performance or furnislung of professional transportation planrung <br /> and engineering services by the Consultant with respect to the Project and the payment for those <br /> services by the City as set forth below. Tlus Agreement will become effective on the date first above <br /> written. <br /> ARTICLE I <br /> CONSULTANT'S RESPONSIBILITIES <br /> The Consultant shall perform for or furnish to the City professional planning,engineering and related <br /> services in all phases of the Project to which this Agreement applies as hereinafter provided. The <br /> Consultant shall serve as the City's prime professional. The Consultant may employ subconsultants <br /> if Consultant deems it necessary to assist in the performance or furnishing of professional planning, <br /> engineering and related services hereunder,but only after the approval of the City has been obtained. <br /> The Consultant shall not be required to employ any subconsultants which are unacceptable to the <br /> Consultant. <br /> The standard of care for all professional planning, engineering and related services performed or <br /> furnished by the Consultant under the Agreement will be the care and skill ordinarily used by <br /> members of the Consultant's profession, practicing under similar conditions at the same time and in <br /> the same locality. <br />
