ARTICLE II <br /> SCOPE OF SERVICES <br /> TO BE PROVIDED BY THE CONSULTANT <br /> The Consultant, will perform or furnish the necessary professional transportation planning and <br /> engineering, and related services for the Project as stipulated below. The Consultant agrees to <br /> perform the Services described in E�ibit"A", Scope of Services. <br /> ARTICLE III <br /> CITY'S RESPONSIBILITIES <br /> The City shall do the following in a timely manner so as not to delay the services of the Consultant <br /> and shall bear all costs incident thereto: <br /> 1. Designate in writing a person to act as the City's representative with respect to the services <br /> to be performed or furnished by the Consultantunder this Agreement. Such person shall have <br /> complete authority to transmit instructions, receive information, interpret and define City's <br /> policies and decisions with respect to the Consultant's services for the Project. <br /> 2. Make available to the Consultant all e�sting records, maps, plans and other information <br /> possessed by the City, which are relevant to the Consultant in the completion of the work <br /> under this Agreement. I <br /> 3. Provide a11 criteria and full information as to City's requirements for the Project, including ' <br /> study objectives and constraints,any budgetary limitatic�ns;and other data which the City will <br /> require to be included in the Project. <br /> 4. Be responsible for, and instruct the Consultant to rely upon, the accuracy and completeness <br /> of all information furnished pursuant to this Article III, City's Responsibilities. Consultant <br /> may use such data and information in performing or furnishing services under this Agreement. <br /> 5. Examine all interim drafts,preliminary and final reports and other documents presented by the <br /> Consultant and render in writing decisions pertaining thereto. <br /> 6. Give prompt written notice to Consultant whenever City observes or otherwise becomes <br /> aware of any development that affects the Scope of Services or the time Schedule of the <br /> Consultant in the performance or furnishing of the required services for the Project, or any <br /> defect or non-conformance in the Consultant's services. <br /> Page 2 of 6 <br />
