ARTICI,E I�i � <br /> TIME SCHEDULE I <br /> The Consultant agrees to com lete the services included in Article II Sco e of Services witlun two I <br /> r , r , <br /> (2)months following receipt of a notice-to-proceed from the City, provided that all uiformation to <br /> be furnished and all reviews to be undertaken by the City are provided and completed without delays. � <br /> ARTICLE V <br /> COMPENSATION <br /> The City agrees to pay the Consultant as compensation for all service performed for the Project, <br /> using the hourly rates and equipment changes as set forth in Exhibit"B" of this agreement. Travel <br /> and other out-of-pocket project expenses will be reimbursed to the Consultant at lus documented cost <br /> or normal rates. Subject to the approval of the City, the Consultant may sublet part of the service <br /> identified in Article II, Scope of Service. if the Consultant subcontracts part of this work, the City <br /> will pay the cost of said subcontract to the Consultant plus a five(5)percent service charge. "Cost <br /> to the Consultant" to be verified by furnishing copies of invoices from the party doing the work. <br /> Anything in the preceding paragraph not withstanding, in no event shall the City be obligated to the <br /> Consultant for any sums in excess of$8,650e00 pursuant to this agreement,unless expressly agreed <br /> to, in writing, by both parties. <br /> Payment for Consultants'services shall be made in installments billed not more frequently than once <br /> each month upon receipt of invoices frorn the Consultant, which sha11 not exceed the overall <br /> percentage complete of the total project. Payment shall be made to the Consultant by the City within <br /> thirty (30) days of invoice date. <br /> ARTICLE VI <br /> GENERAL PROVISIONS <br /> 1. Times for Rendering Service: The Consultant's services and compensation under this <br /> Agreement have been agreed to in anticipation of orderly and continuous progress of the <br /> Project. Specific periods of time for rendering services are set forth in Article IV, Time <br /> Schedule, in this Agreement, by which times defined services are to be completed. If such <br /> periods of time are changed through no fault of the Consultant, the rates and amounts of <br /> compensation provided for therein shall be subject to equitable adjustment. The rates used <br /> in the development of the fee for this project shall remain valid for the duration of any <br /> contract entered into on or before October 31, 1999. <br /> If the City fails to give prompt written authorization to proceed with any phase of services a8er <br /> completion of the immediately preceding phase, the Consultant sha11 be entitled to equitable <br /> adjustment of rates and amounts of compensations to reflect reasonable actual costs incurred by the <br /> Consultant as a result of the delay or changes in the various elements that comprise such rates of <br /> compensation. <br /> Page 3 of 6 <br />
