3. It is mutually agreed by and between the parties hereto that the estimated <br /> cost and cost proration for the improvement to the intersection is as follows: <br /> TOTAL COST $80,000 <br /> Participation and Reimbursement shall be as follows: <br /> COUNTY: Three-Fourths (3/4) of the total cost (not to exceed $60,000) <br /> CITY: One-Fourth (1/4) of the remaining cost (not to exceed $20,000) <br /> 4. The County has passed a resolution appropriating sufficient funds to pay its <br /> share of the cost of this improvement, a copy of which is attached hereto and hereby <br /> made a part hereof. <br /> 5. The County agrees to provide, prior to the advertising for the work to be <br /> perFormed hereunder, approval of the plans and specifications as prepared, by letter. <br /> 6. The City shall exercise its franchise right to cause private utilities to be <br /> relocated at no expense to the County. <br /> 7. Upon completion of the improvement, the County agrees to continue to have <br /> jurisdiction of its roadway including all improvements thereto. <br /> 8. Upon completion of the improvement, the City agrees to continue to have <br /> jurisdiction of its roadways including all improvements thereto and to maintain or cause <br /> to be maintained the traffic signals, as described herein, and any associated highway <br /> lighting including furnishing the electrical energy therefor. It is mutually agreed that the <br /> actual signal maintenance will be perFormed by the City, either with its own forces or <br /> through an ongoing contractual agreement. <br /> 9. The City agrees to make arrangements with the local power company to <br /> furnish the electrical energy for the operation of the traffic signals. The City agrees to <br /> pay its proportionate share of this cost as billed by the local power company. <br /> 10. This agreement and the covenants contained herein shall be null and void in <br /> the event the contract covering the construction work contemplated herein is not <br /> awarded within three (3) years subsequent to execution of the agreement. <br />
