3. It is mutually agreed by and between the parties hereto that the estimated cost and cost proration for the improvement to the intersection is as follows: TOTAL COST $80,000 Participation and Reimbursement shall be as follows: COUNTY: Three-Fourths (3/4) of the total cost (not to exceed $60,000) CITY: One-Fourth (1/4) of the remaining cost (not to exceed $20,000) 4. The County has passed a resolution appropriating sufficient funds to pay its share of the cost of this improvement, a copy of which is attached hereto and hereby made a part hereof. 5. The County agrees to provide, prior to the advertising for the work to be perFormed hereunder, approval of the plans and specifications as prepared, by letter. 6. The City shall exercise its franchise right to cause private utilities to be relocated at no expense to the County. 7. Upon completion of the improvement, the County agrees to continue to have jurisdiction of its roadway including all improvements thereto. 8. Upon completion of the improvement, the City agrees to continue to have jurisdiction of its roadways including all improvements thereto and to maintain or cause to be maintained the traffic signals, as described herein, and any associated highway lighting including furnishing the electrical energy therefor. It is mutually agreed that the actual signal maintenance will be perFormed by the City, either with its own forces or through an ongoing contractual agreement. 9. The City agrees to make arrangements with the local power company to furnish the electrical energy for the operation of the traffic signals. The City agrees to pay its proportionate share of this cost as billed by the local power company. 10. This agreement and the covenants contained herein shall be null and void in the event the contract covering the construction work contemplated herein is not awarded within three (3) years subsequent to execution of the agreement.
