17. Responsibility for Claims and Liabilitv <br /> The Consultant is an independent contractor and not an employee of the City. <br /> Therefore, the Consultant shall indemnify and hold harmless the Client, its <br /> officers, agents and employees from all losses or costs of any nature <br /> whatsoever resulting from the negligence of Consultant in the performance of <br /> work under this Contract. The Client agrees to indemnify and hold harmless <br /> the Consultant, its staff and employees or affiliates, from any and all losses or <br /> costs of whatever kind to the eYtent caused by Client's negligence in <br /> performance of services under this Agreement. <br /> 1 S. Ri�hts and Benefits <br /> The Consultant services will be performed solely for the benefit of the Client and <br /> not for the benefit of any other third parties or entities including, but not limiting to, <br /> lenders, sureties, contractors, tenants, or others not a party to this Agreement. <br /> 19. Insurance <br /> Consultant shall carry sufficient insurance coverage to protect its employees, <br /> officers and agents in the performance of their duties under this Agreement, <br /> and shall also provide any necessary Workers' Compensation coverage. <br /> 20. Authority to Execute <br /> Each party to this Agreement hereby certifies that it possesses authority to execute <br /> the Contract and be bound thereby, and that all prerequisites to such authorized <br /> execution have been accomplished. <br /> 21. Nondiscrimination <br /> Consultant agrees it will not discriminate against any employee or applicant for <br /> employment because of race, religion, sex, national origin, age or handicap. <br /> 22. Notices <br /> All notices required by this Ayreement shall be in�vriting and shall be served either � <br /> personally or by certified mail, or by any other delivery service which obtains a <br /> receipt for delivery, unless such notice is required by law and such law provides a <br /> different form of delivery or service. Any such notice or demand served personally <br /> shall be delivered to the Party being served (provided that such notice may be <br /> delivered to the receptionist or any other person apparently in charge of such party's <br /> � � . , <br />
