5.6 No vehicles used in and on the streets of the City of Decatur for the collection of <br /> recyclables shall be overloaded nor shall such vehicles be parked in any one place while loaded for <br /> any longer than is necessary to collect the materials of the location being served. All vehicles shall <br /> be fully enclosed, leak-proof, and operated in such a way that no recyclables may spill or blow off <br /> the vehicles. Should any recyclables blow off a vehicle due to the operator's failure to properly <br /> monitor the load, to close openings, or due to failure of any mechanism, the Contractor shall be <br /> responsible for collecting or cleaning up such litter. If such litter is not cleaned up after notice <br /> (written or verbal) from the City, the City may clean up same, and the City may bill the cost to the <br /> Contractor for services rendered. All vehicles shall be made available for inspection during <br /> regular business hours at the request of the City. <br /> 5.7 It is understood and agreed that the City may after the effective date of this agreement and <br /> during its term or extensions thereof adopt ordinances which may impose greater, more or stricter <br /> requirements for collection vehicles or Contractor's personnel than are contained in this <br /> agreement. In such event, Contractor shall comply with such ordinance or ordinances in addition <br /> to the provisions of this agreement. It is expressly agreed, however that if City adopts hereafter <br /> an ordinance and as a direct result of which ordinance the Contractor incurs increased costs, then <br /> such increased costs actually incurred by Contractor my be charged by Contractor to the City on a <br /> monthly basis and the City shall pay such costs with and in addition to the monthly payments to be <br /> made pursuant to and subject to the provisions of Section IX hereof. At the request of the City, <br /> Contractor shall deliver to the City paid receipts, invoices or other documents reasonably <br />' requested by the Rec clin Coordinator evidencin such increased costs. <br /> Y g g <br /> VI. LOCAL IMPROVEMENTS AND ANNEXATIONS <br /> 6.1 The City reserves the right to construct any improvement or to permit any construction in <br /> any street, which may have the effect for a time of preventing the Contractor from traveling its <br /> accustomed route or routes for collection. Contractor shall, by an acceptable method, continue to <br /> collect recyclables to the same extent as though no interference existed upon the streets formerly <br /> traversed. This shall be done at no e�rtra cost to the City or to residents. The City agrees to work <br /> with the Contractor to resolve any problems due to construction activity. . <br /> 6.2 Contractor shall service any land annexed into the City during the term of the ageement, <br /> as well as any residential structure constructed during said agreement. Service to annexed land <br /> and residential construction shall be provided on the same terms. <br /> VII. PERSONNEL <br /> 7.1 Contractor is responsible for training the crews that run the collection routes on what <br /> `properly prepared' entitles and how to convey information to residents about proper preparation <br /> 8 <br />
