7. Equipment Provided bv Prairieland. Prairieland shall provide a minimum of <br /> five(5)radio dispatched towing vehicles,dispatched from a manned point base station on a twenty- <br /> four(24)hour basis, seven (7) days per week. In addition to the foregoing, for snow emergency <br /> routes,Prairieland shall provide a minimum of five(5)radio dispatched towing vehicles on no less <br /> than five(5)hours notice provided by the City of the need thereof. Prairieland shall maintain at least <br /> one radio dispatched towing vehicle capable of lawfully towing commercial vehicles of fully loaded <br /> maximum road weight and a flatbed truck to transport vehicles incapable of being towed. <br /> Prairieland also shall provide ar make provision for a"non-public"private telephone line � <br /> between the communications center of the Decatur Police Department and Prairieland for emergency <br /> use. <br /> 8. Res onse Time. Prairieland shall rovide for radio dis atched towin vehicle <br /> P P P g <br /> average response time of no longer than twenty(20)minutes with a maximum of thirty(30)minutes, <br /> subj ect to reasonable requirements and potential emergencies and circumstances beyond the control <br /> of Prairieland. Requests by the City for towing and storage services hereunder shall take priority <br /> over other towing services of Prairieland, except towing services provided other law enforcement <br /> agencies or emergencies. <br /> 9. Prairieland Services. Upon the request of a sworn officer of the Decatur <br /> Police Department or other lawful impoundment officer,Prairieland shall remove and/or impound <br /> any vehicle,not owned or leased by the City,from the streets of the City or adj acent areas. Vehicles <br /> subject to holds placed thereon by the Decatur Police Department shall be stored by Prairieland <br /> subj ect to the reasonable direction of the Decatur Police Department or as may be directed by a court <br /> of competent jurisdiction. Vehicles towed and/or stored pursuant to the terms hereof,which vehicles <br /> are not subject to a "hold" placed thereon by the Decatur Police Department, shall be released in <br /> accordance with the provisions of§ 16 hereof. <br /> In addition, in the case of a vehicular collision or automobile accident,where the owner or <br /> operator,for whatever reason is incapacitated or otherwise incapable of approving a towing service, <br /> or the owner or operator does not request the services of a specific towing services company, and <br /> the Decatur Police Department is authorizing the provision of towing and/or storage services,the <br /> Decatur Police Department will contact Prairieland to perform the towing and/or storage services, <br /> and Prairieland shall provide such services. <br /> Prairieland also shall provide towing services for periodic Decatur Police Department <br /> auctions upon notice of not less than seventy-two(72)hours. Prairieland also will work diligently <br /> with the city in order to provide four (4) radio dispatched towing vehicles for the "Streets for <br /> Storage"program presently used by the City,which shall be on notice of not less than twenty-four <br /> (24) hours to Prairieland. Prairieland also shall provide towing services to the City for vehicles <br /> owned or leased by the City,which vehicles are of a gross vehicle weight of less than 10,000 pounds, <br /> at no cost to the City. <br /> -4- <br />
