ADDENDUM TO AGREEMENT <br /> � <br /> This Addendum to Agreement is entered into and shall become effective on this.�day of <br /> April, 1999, by and between the City of Decatur, Illinois, an Illinois municipal corporation (the <br /> "City") and James L. Williams, Jr. (the "Employee"), a resident of the City of Decatur, County of <br /> Macon, State of Illinois. <br /> WITNESSETH: <br /> WHEREAS, the City and the Employee are parties to a certain <br /> Agreement entered into previously by them on or about September 3, <br /> 1996, the terms of which have been renewed subsequently and the <br /> terms of which have been subject to prior addenda; <br /> WHEREAS,the Employee has stated an intention to resign from his <br /> position of employment with the City, and in recognition of the <br /> valuable services provided by the Employee to the City, the City <br /> desires to provide to the Employee the benefits described more fully <br /> herein; <br /> WHEREAS, the provisions herein are recognized by the parties <br /> hereto as becoming effective and binding only upon the acceptance <br /> of the terms hereof by the lawfully constituted City Council of the <br /> City upon proper resolution; and <br /> WHEREAS, the parties hereto wish to further amend the prior <br /> Agreement existing between them by the provisions set forth herein. <br /> NOW THEREFORE,in consideration ofthe mutual terms,covenants,conditions,promises <br /> and benefits described herein, together with Ten Dollars ($10.00), in hand paid, the receipt and <br /> sufficiency of which are hereby acknowledged, the parties hereto do hereby covenant and agree as <br /> follows: <br /> 1. Pursuant to the terms of the presently existing Agreement between the parties hereto, <br /> the Employee is entitled to twenty(20) days of paid vacation on an annual basis, and he is entitled <br /> to certain carry-over provisions of unused vacation from one calendar year to the next calendar year, <br /> all as is more fully set forth within said Agreement. <br />
