City shall indemnify and hold harmless the County and its Board <br /> members, officers, employees and agents, and the Sheriff, in both <br /> their individual and official capacities, from all claims for <br /> bodily injury, death, property damage, sanctions imposed by a <br /> Court, or damages i.mposed pursuant to FOIA resulting from or <br /> arising out of the County's performance of the records function, as <br /> described herein, and from all costs, demands, suits, losses, <br /> attorney's fees and liabilities incurred in or about any such claim <br /> for bodily injury, death, property damage, failure or delay in <br /> providing a response to a subpoena or request pursuant to FOIA or <br /> any action or proceeding brought therein. <br /> (b) To the extent permitted by law, the County � shall <br /> indemnify and hold harmless the City and its Council members, <br /> officers, employees and agents, in both their individual and <br /> official capacities, from all claims for bodily injury, death or <br /> property damage resulting from or arising out of the City's <br /> performance of the co�unications function, as described herein, <br /> and from all costs, demands, suits, losses, attorney's fees, and <br /> liabilities incurred in or about any such claim for bodily injury, <br /> death or property damage or any action or proceeding brought <br /> therein. <br /> (c) The County shall further indemnify the City for any <br /> damage to City communications equipment, including related <br /> computers, caused by the remodeling of the Law Enforcement Center <br /> done to accommodate such equipment and to permit the performance of <br /> the City's duties and obligations hereunder, such damage expressly <br /> - 5 - <br />
