Nothing in this Agreement shall be construed <br /> to require any party hereto to employ any minimum or maximum number <br /> of employees in order to effect the provisions hereof, provided, <br /> however, that no such party may sub-contract all or any part of the <br /> aforesaid records or communications functions without the express <br /> written consent of all other parties . <br /> 8 . FREEDOM OF INFORMATION; SUBPOENAS. Requests pursuant to <br /> FOIA and subpoenas seeking records belonging to the City shall be <br /> directed to the City's Corporation Counsel, and neither the Sheriff <br /> nor the County shall disclose or deny disclosure of such records or <br /> information to the person or entity seeking same unless authorized, <br /> in writing, by the City. At its discretion, the City may provide <br /> the County and the Sheriff with written instructions for responding <br /> generally to such requests and subpoenas, and the County and the <br /> Sheriff may rely on such instructions in releasing said records. <br /> 9 . RELEASE. To the extent permitted by law, each party <br /> hereto does hereby fully and forever release and discharge the <br /> other parties, and the City Council and County Board members, <br /> employees, officers and agents of same, in both their individual <br /> and official capacities, from any and all claims, demands, damages, <br /> rights of action or causes of action, present or future, whether <br /> due to negligence or otherwise, resulting from or arising out of <br /> the compliance, or attempted compliance, by same with the terms and <br /> provisions hereof. <br /> 10 .
