� � <br /> � � <br /> AGREEMENT <br /> The City of Decatur, Illinois, ("City"), a municipal corporation, and Ron Herbstrith, d/b/a <br /> Friedman's Paint and Wallpaper("Freidman's"),hereby agree as follows: <br /> 1. Friedman's shall organize, implement and manage a one (1) day paint collection and <br /> recycling/disposal ("collection") of latex and oil based paint from Decatur residents on October <br /> 31, 1998, in accordance with the terms and provisions of this Agreement, and with the terms and <br /> conditions of the Request For Proposals For Paint Collection and Recycling/Disposal Services, <br /> dated August 27, 1998, which Request is attached hereto and hereby made a part hereof; <br /> provided that, in no event shall Friedman's be required to collect in excess of 20,000 containers. <br /> If there is a conflict between the provisions contained in the body of this Agreement and the <br /> provisions of said Request For Proposals,the provisions contained in the body of this Agreement <br /> shall control. <br /> 2. The City shall pay to Friedman's the sum of Fifteen Thousand Dollars ($15,000.00) for <br /> said collection, plus One Dollar ($1.00) per container for each container over fifteen thousand <br /> (15,000) containers which is collected; provided that, in no event shall the City be liable far more <br /> than Twenty Thousand Dollars ($20,000). <br /> 3. Said collection shall be conducted at the Illinois Power Company facility located at <br /> 2460 North Jasper Street in Decatur. Said collection shall be conducted from 8:00 A.M. to 12:00 <br /> P.M.; provided that, at the discretion of the City, said collection may be extended to 1:00 P.M. <br /> 4. Friedman's shall be responsible to mobilize, manage, oversee and demobilize all <br /> collection operations and the collection, location, transport and recycle/disposal of the material <br />
