Dollars ($37,500), or one-fourth (1/4) of the total cost of adjacent improvements, whichever is <br /> less, and each increment is payable only after (a) the issuance of each building permit for the <br /> Premises, pursuant to Chapter 67 of the City Code, or (b) the issuance of any such permit or <br /> permits for each finrenty-five thousand (25,000) square feet of building space, whichever of (a) or <br /> (b) first occurs. The Owners shall not be responsible for the cost of any improvements to any <br /> portion of Maryland Street not adjacent to the Premises, but the City may require the Owners to <br /> construct such improvements in conjunction with the adjacent improvements and shall reimburse <br /> the Owners for the full cost thereof. "Cost", for the purposes hereof, shall include engineering <br /> costs for the design of said streets. <br /> 8. The Owners shall construct an earthen berm eight (8) feet in height for one-half the <br /> length of the East property line of the Premises, as shown on said Exhibit B, said berm to be <br /> constructed with a 4 to 1 slope and landscaped as required by the Department o# Community <br /> Development. Said berm shall be constructed along the remainder of said East property line <br /> upon the issuance of a second building permit for the Premises. <br /> 9. The Premises shall not have vehicular access from either Maynor Street or Mulberry <br /> Drive. <br /> 10. The Owners shall construct all on-site improvements, including any extensions of City <br /> utilities such as water and sewer mains, at their expense. <br /> 11. The City shall assist the Owners' efforts to secure sanitary sewer access for this <br /> property. The City's efforts shall include, but are not limited to, executing the Owners' EPA <br /> permits and cooperating with the Owners to obtain the Sanitary District of Decatur approval of the <br /> Owners' EPA permits. Regarding traffic signalizations at the corner of 44th Street and U.S. <br /> Route 36 East, the City agrees to facilitate the request to the State of Illinois and the City will be <br /> responsible for ownership and maintenance of the traffic signalization after the traffic <br /> signalization has been installed at the cost of the Owners and to the satisfaction of the City. <br />
