e � <br /> �C <br /> E%HIBZT 8 <br /> 1999, including any extensions of time which the Authority may <br /> grant, then the Contractor shall pay to the Authority the sum of <br /> $250 .00 for each consecutive day (including Saturdays, Sundays and <br /> holidays) , or part thereof, that th� Contractor shali be in default <br /> after the Contract time stated in the Contract documents. <br /> (f) The Contractor shall not be charged with daily liquidated <br /> damages when the delay in compietion of the work is due to the <br /> following and the Contractor has promptly given written notice of <br /> such delay to the Authority: by any act or neglect of the <br /> Authority; changes ordered in the work in which the time of <br /> extension of the completion date has been stated; labor disputes; <br /> fire; unavoidable casualties; or any cause beyond the Contractor' s <br /> control (with the Contractor also following the procedure stated in <br /> Paragraph 13(b) of the Contract as to claims for additional time) . <br /> (g) Notwithstanding any other provision contained in the <br /> Contract documents, the Authority and the Contractor expressly <br /> agree and understand that no action by the Authority or payment of <br /> any nature or kind, including, but not limited to, progress <br /> payment, final payment, payment for work performed, by the <br /> Authority to the Contractor after the expiration of the Contract <br /> time shall be considered ( 1) a waiver or release by the Authority <br /> of the performance of the terms of the Contract by the Contractor <br /> within the Contract time, (2) approval of or acquiescence in the <br /> breach by the Contractor of performance of the terms of the <br /> EBHZBIT 8 Page 3 <br /> I <br /> � <br /> 1 <br />
