The parties <br /> hereto agree that the only manner in which the Authority may waive <br /> or release any right of the Authority to daily liquidated damages <br />, against the Cont�actor is to have such waiver or release <br /> specifically agreed to in writing signed by the Authority. <br /> (h) The Authority hereby expressly reserves ali rights and <br /> remedies which are not specifically related to deiay da.�nages, which <br /> reservation shall include any and all rights and remedies <br /> pertaining to, among other items and without limitation, any breach <br /> of this Contract or the Contract documents, such as, but not <br /> exclusively, a breach of any of the conditions contained in <br /> paragraphs 2, 3, 6 and 8 of this Contract and all other provisions <br /> contained in the Contract and Contract documents. Such provisions, <br />' conditions and items are hereby specifically not included in the <br /> delay damages provided for in paragraph 14 hereof. <br /> (i) "Opera.ble" is defined as the stage in the progress of <br /> the completion of the component part so that such part may be <br /> utilized and be effective for the purpose for which it is intended <br /> to be used.
