'�� ���. �a�E � � � <br /> ANNEXATION AGREEMENT <br /> This Annexation Agreement made by and between the City of Decatur, Illinois, a Municipal <br /> Corporation ("City"), the Alvin T. Boyd Family Trust, John Tryner and Amy Tryner (collectively, <br /> "Owner"), and Janko Financial Group, L.L.C. ("Janko"). <br /> WHEREAS, Owner owns the following described premises: <br /> The Northwest Quarter (NW 1/4) of the Northwest Quarter (NW 1/4) of <br /> Section 29, Township 17 North, Range 3 East of the Third Principal <br /> Meridian, Macon County, Illinois, lying East of Brush College Road <br /> right-of-way, Southeast of Illinois Route 48 right-of-way and South of <br /> Boyd Road right of way; <br /> ("Premises"), <br /> which Premises are outside of the corporate limits of the City but not contiguous thereto; and, <br /> WHEREAS, Owner desires to annex said Premises to the City when contiguous, but only upon <br /> certain terms and conditions; and, <br /> WHEREAS, Janko has a contract to purchase and develop said Premises, but only upon certain <br /> terms and conditions; and, <br /> WHEREAS, the City agrees that said terms and conditions, as contained herein, are reasonable <br /> and acceptable; and, <br /> WHEREAS, hearings have been held and notice given as required by law. <br /> NOW, THEREFORE, for and in consideration of the mutual promises and obligations contained <br /> herein, and pursuant to the autharity of 65 ILCS 5/11-15.1-1, the City, Owner and Janko agree as <br /> follows: <br /> 1. Within ninety (90) days of the Premises becoming contiguous to the City, the Owner, or the <br /> heirs, successors or assigns of any or all of them with regard to the Premises, or any portion thereof, <br /> shall file an annexation petition with the City, in compliance with 65 ILCS 5/7-1-8, said petition to <br /> J <br />
