The City hereby waives any requirement otherwise applicable that Owner pays to the City any <br /> fee for filing the petition referred to in paragraph 1 hereof. <br /> 3. Upon receipt of said annexation petition,the City shall annex the territory described therein to <br /> the City as provided by law. <br /> 4. (a) To the extent permitted by the Illinois Environmental Protection Agency("IEPA") and the <br /> Sanitary District of Decatur, the City shall extend sewer and water service to the Premises not later than <br /> four (4) months after permits have been approved by the IEPA; provided that, any failure of the City to <br /> meet the date established herein due to events constituting force majeur shall not be considered a default. <br /> Said water and sewer service shall be extended along the east side of Brush College Road to the <br /> intersection of Rt. 48. The City shall make all necessary applications to the IEPA, through the Sanitary <br /> District, not later than thirty (30) days after all necessary information is provided to the City by the <br /> Owner. <br /> _ (b) The Owner shall pay all fees normally and customarily charged by the City for tapping the <br /> water and sewer mains constructed pursuant to subsection(a). <br /> (c) The Owner shall pay for water service at the rate normally and customarily charged water <br /> users located inside the corporate limits of the City, as provided by Chapter 64 of the City Code, now or <br /> as hereafter amended. <br /> 5. (a) Janko shall construct a road, with water and sewer mains, on said Premises, which road <br /> shall intersect with Brush College Road and shall extend easterly therefrom as shown on the plans <br /> therefor attached hereto as Exhibit A. Janko shall further construct a drainage retention area north of <br /> and adjacent to said road, also as shown on said Exhibit A. Such road and water and sewer mains and <br /> such drainage retention area shall be built in accordance with plans and specifications approved by the <br />
