<br /> Telephone# , Contractor(s)for the purpose of removing certain fish from Lake Decatur in Macon Countv as
<br /> authorized by 515 ILCS 5/1-135, the Illinois Fish and Aquatic Life Code. Natural Resources and the Contractor agree as
<br /> follows:
<br /> 1. Natural Resources and the City of Decatur assume no liability for injury or damages to Contractor or his crew
<br /> members;Contractor will indemnify and hold harmless Natural Resources and the City of Decatur and their agents
<br /> and employees from ail risks,suits,damages,and claim arising out of this contract. Contractor will not be permitted to
<br /> assign,subcontract or othervvise transfer this contract. Contractor shall carry general liability insurance in an amount
<br /> not less than one million dollars per occurrence and aggregate, and shall name the City of Decatur addidonal insured
<br /> for work done under the contract.
<br /> 2. Any individual who has been found guilty of a violation of the Fish and Aquatic Life Code or 17 III.Adm.Code or
<br /> Administ�at9ve R�le 830 during the p�st 12 months is n�t eligible fc�r�commercia!fishing contract(830:80,C2).
<br /> Contractor shall comply with all regulations of this contract. Such fish removal shall be subject to inspection and
<br /> supervision by Conservation Police Officers and Site Personnel.
<br /> 3. Only one crew(defined as only those individuals listed on this contract who must be working with the contractor on the
<br /> same device at the same time) is authorized by this contract. For each boat used,a licensed commercial fisherman
<br /> must be in each.
<br /> 4. Commercial fishing will be permitted Monday through Thursday from 7:00 A.M.to 4:00 P.M.and Friday from 7 A.M.to
<br /> 2 P.M.during the contract period. Fishing will not be allowed on Saturday s ,Sundays, or holidays(January 19,
<br /> February 12, 1998). Fishing will be permitted south of Rea's Bridge . At no time will commercial fishing be permitted
<br /> within 100 yards of the lake spillway or launching areas. Neither contractor nor his crew members will be permitted on
<br /> any portion of Lake Decatur except the authorized fishing area and at no time other than the daily authorized fishing
<br /> period as indicated in this paragraph. Fishing will only be permitted when open water condi6ons prevail during the
<br /> contract fishing period. Only seines or trammel.nets may be used. Only"pound or drive"fishing will be permitted using
<br /> three (3.0)inch bar mesh t�ammel nets or larger of a legal size and legally licensed by the contracter. No dead setting
<br /> of trammel nets will be permitted. Durina the first finro davs of fishinsa contractor must be accompanied bv a DNR
<br /> employee. If seining results in capture and mottality of too many game fish,seining will no longer be allowed. Upon
<br /> completion ofeach week of fishing,contractor shallprovide the City of Decatur Lake Management office with a report of
<br /> the pounds of each species harvested,sold,and disposed of by 4:00 P.M.Friday of the same week. Access to and
<br /> from the lake must be by way of the Nelson Park Ramp adjacent to the Lake Patrol O�ce.
<br /> 5. The only species of fish that may be taken are carp,carpsuckers,suckers,drum,bo�n,gar and grass carp. No carp,
<br /> carpsuckers, bo�n or gar may be returned to the lake. All game fish must be released immediately upon raising of
<br /> nets. All buffalo captured must be removed from the lake and placed into a City of Decatur dump truck adjacent to the
<br /> ramp.
<br /> 6. Any Contractor or his/her crew members,who are cited for a violation of the 1992 515 ILCS Fish and Aqua6c Life Code
<br /> as amended,Administrative Rule 830,or provisions of this contract,will have their fishing privileges suspended until
<br /> final adjudication of their citation. If the Contract or his/her crew members are found guilty of violation of any of the
<br /> above Department regulator measures,their contract will be revoked and they will be subject to the penalties as set
<br /> forth in 515 ILCS 5/20-35 and 20-105 (1992). Further, any person found guilty, pleading guilty, or having exparte
<br /> judgement entered of a Fish and Aquatic Life Code violation (whether under this contract or elsewhere)will be
<br /> ineligible for a commercial fishing contract to fish in any waters open to commercial fishing by contract or to serve as
<br /> member of a contract fishing crew for a period of not less than one year(Adm. Rule 830.80,C.2.).
<br /> 7. Personnel from the Division of Fisheries or City of Decatur Lake Management may cancel or suspend this contract any
<br /> time upon written notice presented to the Contractor and the Contractor must immediately terminate all fishing activities
<br /> at the site covered by the contracts which are terminated and must remove crew,boat and all equipment from the site
<br /> upon such notice.
<br /> 10. This authorization shall be e�ffective from date i suance thro��.gh.l�,/lat�h 31. 1998, unless cancelled or suspended
<br /> prior t�this date.
