provided for,the ENGINEER shall be responsible for any loss or damage to the <br /> documents herein enumerated while they are in the ENGINEER'S possession and any <br /> such loss or damage shall be restored at the ENGINEER'S expense. <br /> 5. To attend conferences to be held at the request of the CITY and visit the site of the work <br /> at any reasonable time when requested to do so by the CITY. <br /> 6. That tracings, plans, specifications, estimates,maps and other documents prepazed by the <br /> ENGINEER in accordance with the AGREEMENT shall be delivered to and become the <br /> property of the CITY and that basic survey notes, sketches, charts, and other data <br /> prepared or obtained in accordance with this AGREEMENT shall be made available, <br /> upon request,to the CITY, without restriction or limitation as to their use. <br /> 7. That should the CITY require changes in any of the detailed construction plans, <br /> specifications, or estimates after they have been completed in accordance with the <br /> contract or as a result of policy changes by the CITY during the time work is underway, <br /> the CITY shall pay the ENGINEER for such extra in accordance with the Section THE <br /> CITY AGREES. <br /> « „ <br /> It is understood that changes as used in this section means basic changes in the detailed <br /> scope of work contained herein, such as in location or in design and that the provisions <br /> of this section shall in no way relieve the ENGINEER of his responsibility to prepare a <br /> complete and adequate set of plans satisfactory to the CITY. <br /> 8. That the fullest extent not prohibited by law,the ENGINEER shall indemnify and hold <br /> harmless the CITY, its officers, agents and employees from and against all claims, <br /> damages, losses and expenses (including but not limited to attorney's fees) arising by <br /> reason of any negligent acts, errors, or omissions of the ENGINEER, or of any other , <br /> persons for whose acts the ENGINEER is legally liable, in the performance of , <br /> professional services under this AGREEMENT. I <br /> 9. That he will comply with applicable Federal Statutes, State of Illinois Statutes, and local <br /> laws or ordinances of the CITY, including but not limited to: <br /> A. That the ENGINEER will comply with the provisions of Section 3,the regulations <br /> set forth in 24 CFR 135, and all applicable rules and orders issued hereunder prior <br /> to the execution of this contrct, shall be a condition of the federal financial <br /> assistance provided under this contract and binding upon the City,the contractor <br /> and any sub-contractors. Failure to fulfill these requirements shall subject the <br /> City,the contractor, and any sub-contractors,their successors and assignes, to <br /> those sanctions specified by the agreement through which federal assistance is <br /> provided.
