. . , . <br /> r• • • • <br /> " e <br /> � AGREEMENT <br /> This AGREEMENT is entered into by and between the STATE OF ILLINOIS, acting by and <br /> through the Illinois Department of Transportation, hereinafter called the STATE, and the City of <br /> Decatur, in Macon County, of the State of Illinois, hereinafter called the LOCAL AUTHORITY. <br /> WITNESSETH: <br /> WHEREAS, a CAUTION XX FEET BETWEEN TRACKS AND HIGHWAY and DO NOT STOP <br /> ON TRACKS signs are appropriate sign to use on a road o� street approach to a railroad grade <br /> crossing where the distance between the rail closest to a subsequent STATE highway and the <br /> point at which a vehicle would normally stop for the highway for either a STOP sign or traffic <br /> signal is less than 25 m (81 ft); and <br /> WHEREAS, the LOCAL AUTHORITY, in accordance with Section 11-304 of the Illinois Vehicle <br /> Code (625 ILCS 5/11-304) have the responsibility and authority to place and maintain traffic <br /> control devices upon highways and roads under their jurisdiction; and <br /> WHEREAS, the STATE and the LOCAL. AUTHORITY are empowered by the Illinois Highway <br /> Code to enter into cooperative agreements to provide for the maintenance, administration, <br /> engineering, and improvement of any highway or portion thereof; and <br /> WHEREAS, an intergovernmental cooperative agreement is also an appropriate method to <br /> achieve the purposes of the STATE and the LOCAL AUTHORITY, and such an agreement is <br /> authorized and encouraged by Article VII, Section 10 of the Constitution of 1970 and the <br /> "Intergovernmental Cooperation Act"; <br /> NOW THEREFORE, in consideration of the premises and mutual covenants contained herein, <br /> the parties hereto agree as follows: <br /> 1. The STATE shall erect, at its expense, the CAUTION XX FEET BETWEEN TRACKS AND <br /> HIGHWAY signs shown on Exhibit 1 and listed in Exhibit 2, which exhibits are attached <br /> hereto and incorporated herein by reference. <br />, 2. Upon approval of the sign installations, by the LOCAL AUTHORITY, the LOCAL <br /> AUTHORITY shall repair or replace, at its expense, the CAUTION XX FEET BETWEEN <br /> TRACKS AND HIGHWAY signs listed in Exhibit 2, at such time as they determine that any <br /> such sign is missing, damaged, in need or repair or replacement, as well as make any <br /> changes to the distance shown on the sign resulting from revisions to the pavement marking <br /> at the intersection, intersection geometrics, railroad alignment, or any other occurrence <br /> which decreases or increases said distance. <br /> 3. The LOCAL AUTHORITY shall notify the STATE at its appropriate District Office in writing of <br /> any revisions made to the distance shown on any CAUTION XX FEET BETWEEN TRACKS <br /> AND HIGHWAY sign. <br />
