. . , . r• • • • " e � AGREEMENT This AGREEMENT is entered into by and between the STATE OF ILLINOIS, acting by and through the Illinois Department of Transportation, hereinafter called the STATE, and the City of Decatur, in Macon County, of the State of Illinois, hereinafter called the LOCAL AUTHORITY. WITNESSETH: WHEREAS, a CAUTION XX FEET BETWEEN TRACKS AND HIGHWAY and DO NOT STOP ON TRACKS signs are appropriate sign to use on a road o� street approach to a railroad grade crossing where the distance between the rail closest to a subsequent STATE highway and the point at which a vehicle would normally stop for the highway for either a STOP sign or traffic signal is less than 25 m (81 ft); and WHEREAS, the LOCAL AUTHORITY, in accordance with Section 11-304 of the Illinois Vehicle Code (625 ILCS 5/11-304) have the responsibility and authority to place and maintain traffic control devices upon highways and roads under their jurisdiction; and WHEREAS, the STATE and the LOCAL. AUTHORITY are empowered by the Illinois Highway Code to enter into cooperative agreements to provide for the maintenance, administration, engineering, and improvement of any highway or portion thereof; and WHEREAS, an intergovernmental cooperative agreement is also an appropriate method to achieve the purposes of the STATE and the LOCAL AUTHORITY, and such an agreement is authorized and encouraged by Article VII, Section 10 of the Constitution of 1970 and the "Intergovernmental Cooperation Act"; NOW THEREFORE, in consideration of the premises and mutual covenants contained herein, the parties hereto agree as follows: 1. The STATE shall erect, at its expense, the CAUTION XX FEET BETWEEN TRACKS AND HIGHWAY signs shown on Exhibit 1 and listed in Exhibit 2, which exhibits are attached hereto and incorporated herein by reference. , 2. Upon approval of the sign installations, by the LOCAL AUTHORITY, the LOCAL AUTHORITY shall repair or replace, at its expense, the CAUTION XX FEET BETWEEN TRACKS AND HIGHWAY signs listed in Exhibit 2, at such time as they determine that any such sign is missing, damaged, in need or repair or replacement, as well as make any changes to the distance shown on the sign resulting from revisions to the pavement marking at the intersection, intersection geometrics, railroad alignment, or any other occurrence which decreases or increases said distance. 3. The LOCAL AUTHORITY shall notify the STATE at its appropriate District Office in writing of any revisions made to the distance shown on any CAUTION XX FEET BETWEEN TRACKS AND HIGHWAY sign.
