The CITY agrees to pay 100% of the CITY's financial participation in excess of the STATE's maxunum participation of$141,000. It is further agreed, should the CITY's final participation be less than $141,000, the lesser amount shall be considered the STATE's total contribution to the CITY for accepting jurisdiction of the highways described above. 5. The CITY has passed a resolution appropriating sufficient funds to pay its share of the cost of this improvement, a copy of which is attached hereto as "Exhibit A" and made a part hereof. 6. The CITY agrees to adopt and will put into effect, prior to the STATE's advertising for the work to be performed hereunder or continue to enforce an ordinance requiring that parking be prohibited within the limits of this improvement, a copy of which is attached hereto as "Exhibit B", and will in the future prohibit parking at such locations on or immediately i adjacent to this improvement as may be determined necessary by the STATE from traffic ; capacity studies. i 7. The CITY agrees to adopt and will put into effect, prior to the STATE's advertising for the II work to be performed hereunder, and appropriate ordinance prohibiting the discharge of 'i sanitary sewage and industrial waste water into any storm sewers constructed as a part of this improvement, a copy of which is attached hereto as "Exhibit C". 8. The CITY agrees to provide prior to the STATE's advertising for the work to be performed hereunder approval of the plans and specifications as prepared, by resolution or letter. 9. The CITY agrees not to permit driveway entrance openings to be made in the curb as constructed, without the consent of the STATE. � 10. The CITY shall exercise its franchise right to cause private utilities to be relocated at no expense to the STATE. 4
