� ' 3. Lessee shall pay in advance a rental of Twelve Thousand Dollars ($12,000) per year, <br /> with the first such rental payment being made on or before the 1 st day of January, 1997, and <br /> future annual rental payments being due and payable on or before the first day of each January <br /> thereafter during the Term hereof; provided that, if this Lease is terminated prior to the end of <br /> any year during said Term, Lessee shall be refunded,pro rata, any rent paid for such period. <br /> 4. Without in any way limiting the rights granted to Lessee by virtue of the lease, demise <br /> and letting of the Premises as provided for in Paragraph 1, above, including, without limitation, <br /> the right of Lessee to the sole and exclusive use and possession of the Premises, Lessor hereby <br /> expressly grants to Lessee exclusively the following rights during the Term of this Lease: <br /> (a) The right to go in and out freely from the Premises, including the <br /> right to widen and improve existing roads and construct new roads within <br /> the Premises in a manner that is most convenient for the operations of <br /> Lessee or its associated parties, and in a manner designed to minimize, to <br /> the extent practicable, any inconvenience and damage to Lessor resulting <br /> from the preparation and use of open rights-of-way. <br /> (b) The right to erect, operate and maintain on the Premises plants, <br /> buildings, fixtures and/or attachments necessary or convenient to the I <br /> operations carried on by Lessee or its associated parties; <br /> (c) The right to install, operate and maintain on the Premises power i <br /> lines, telephone lines, poles, guy wires and any other attachments, water '' <br /> and sewer lines, railroad spur tracks and other similar installations or <br />
