. � , ' utilities necessary or convenient to the operations carried on by Lessee or <br /> its associated parties, which installation, operation and maintenance shall <br /> be in a manner designed, to the extent practicable, to minimize any <br /> inconvenience and damage to Lessor; <br /> (d) The right to use, at no cost, water in rivers, creeks or ponds located <br /> on the Premises, and the right, at Lessee's expense, to drill and operate <br /> such water wells as are necessary or convenient to the operations of Lessee <br /> hereunder. <br /> 5. Lessee shall remove all plants, buildings, spur tracks or other fixtures and attachments <br /> erected or placed on the Premises during the Term of this Lease by Lessee or its associated <br /> parties. <br /> 6. If at any time, in the sole discretion of Lessee, the sand or other construction material <br /> becomes depleted or the removal thereof becomes impossible or not economically feasible due to <br /> market conditions or due to the scarcity thereof located on Lessee's Premises, or due to any <br /> zoning law or other land use regulation or to any order or ruling of any court or other <br /> governmental entity, Lessee may, by giving notice to Lessor, terminate this Lease. Termination <br /> shall become effective and the rights, duties and privileges of the parties hereunder shall <br /> terminate thirty (30) days from the posting of said notice. <br /> 7. If Lessee or its associated parties are prevented, after commencing operations, from <br /> operating as described in Paragraph 4 hereof because of the fact that title to, or the right to the <br /> temporary use of all or part of the Premises is taken under the exercise of the power of eminent <br /> _ � <br />
