�: . ° , <br /> FAP Route 323 (US 36) <br /> Section (139X-2)TS-3 <br /> Macon County <br /> Contract No. 90881 <br /> C-95-O50-97 <br /> Agreement No. JN-597015 <br /> AGREEMENT <br /> This agreement, entered into this ,/� � day of , A.D. 19�, <br /> by and between the STATE OF ILLINOIS, acting by and through i DEPARTMENT OF <br /> TRANSPORTATION hereinafter called the STATE, and the City of Decatur in Macon <br /> County, of the State of Illinois, hereinafter called the CTTY, Macon County of the State of <br /> Illinois, hereinafter called the COUNTY, and Long Creek Township of the State of Illinois, <br /> hereinafter called the TOWNSHIP. <br /> WITNESSETH: <br /> WHEREAS, the STATE, CITY, COUNTY, and TOWNSHIP in order to facilitate the free <br /> flow of traff'ic and insure safety to the motoring public are desirous of improving the <br /> intersectiont of FAP Route 323 (U.S. 36) with Baltimore Avenue (FAU Route 7449); and <br /> WHEREAS, Baltimore Avenue (FAU Route 7449) is the jurisdiction of the TOWNSHIP; and <br />� <br /> WHEREAS, the improvement to the intersection of US Route 36 with Baltimore Avenue shall <br /> consist of installing traff'ic signals which shall include detector loops, controller, controller <br /> cabinet, signal posts, mast arms, signal heads; upgrading pavement markings; and by <br /> performing all other work necessary to complete the improvement in accordance with <br /> approved plans and specifications; and <br /> NOW, THEREFORE, in consideration of the mutual covenants contained herein, the <br /> parties hereto agree as follows: <br /> 1. The STATE agrees to make the surveys, obtain all necessary rights of way, <br /> prepare plans and specifications, receive bids and award the contract, furnish <br /> engineering inspection during construction and cause the improvement to be <br /> built in accordance with the plans, specifications and contract. <br /> 1 <br />
