2. The STATE agrees to pay all rights-of-way, construction and engineering costs, <br /> subject to reimbursement by the COUNTY and TOWNSHIP as hereinafter <br /> stipulated. <br /> 3. Cost shall be determined by multiplying the final quantities times contract unit <br /> prices plus 15% for construction and preliminary engineering. COUNTY and TOWNSHIP <br /> participation toward the traffic signals at Baltimore Avenue shown above shall each not exceed <br /> $2,444 which represents 125% of their estimated construction and engineering cost. <br /> 4. The COUNTY has passed a resolution appropriating sufficient funds to pay its <br /> p share of the cost of this improvement, a copy of which is attached hereto as <br /> "E�chibit A" and made a part hereof. <br /> 5. Upon award of the contract for this improvement the TOWNSHIP agrees to.pay <br /> the STATE in a lump sum from any funds allotted to the TOWNSHIP, an <br /> amount equal to 95% of its obligation incurred under this Agreement, and will <br /> pay the remainder of the obligation(including any non-participating costs on <br /> FAP projects) in a lump sum, upon completion of the project based upon final <br /> costs. <br /> 6. The COUNTY, CITY and TOWNSHIP agree to provide prior to the STATE'S <br /> advertising for the work to be performed hereunder approval of the plans and <br /> specifications as prepared, by resolution or letter. <br /> 7. The CITY and TOWNSHIP shall exercise their franchise right to cause private <br /> utilities to be relocated at no expense to the STATE. <br /> 8. The CITY agrees to cause its utilities located on right of way acquired by the <br /> State or installed within the limits of a roadway after the said roadway was <br /> taken over for maintenance by the State, to be relocated and/or adjusted at no <br /> expense to the State. <br /> 2 <br />
