ENTLER EXCAVATING COMPANY, INC._ <br /> CITY COUNSEL BRIEF <br /> SUMMARY OF FACTS• <br /> Water main Extension Project Number 9601 was scheduled <br /> for bids to be opened on Thursday, March 6, 1997 at 2 : 00 p.m. <br /> Prior to March 6, Entler Excavating Company, Inc. obtained the <br /> prints for the purpose of bidding on the project. On March 6, <br /> 1997, Entler Excavating provided a proposal (hereinafter <br /> referred to as "bid") . On March 6, 1997 , all bids regarding <br /> the project were opened and Entler Excavating Company' s bid <br /> was the lowest bid. <br /> On Friday, March 7 , 1997 , at 7 : 15 p.m. , Entler' s were <br /> requested by phone conversation with Bill Ratekin to provide <br /> references. On Monday, March 10, 1997, at 3 : 30 p.m. , Entler's <br /> hand delivered a written document including five construction <br /> references and information regarding water main projects <br /> completed or in progress. The City Engineer and/or assistant <br /> City Engineer contacted only two of the five references as of <br /> Wednesday, March 12 , 1997 . <br /> By letter dated Wednesday, March 12 , 1997 , City Engineer, <br /> Steven Swanson, apparently acting on his own, drafted a <br /> letter indicating to Entler' s that their lowest bid was being <br /> recommended for rejection by the City Engineer, further <br /> indicating that the bid bond was being returned. That letter <br /> was signed by Steven P. Swanson with carbon copies to Bruce A. <br /> McNabb, Director of Public Works, William A. Ratekin, <br /> Assistant City Engineer, John W. Couter, Corporate Counsel and <br /> Celeste F. Harris, City Clerk. In Mr. Swanson' s March 12 <br />
