Unfortunately, George Scherer, on advice of <br /> counsel, was unable to respond in writing as were the members <br /> of the Capital Development Board. <br /> The most important contact that was made regarding <br /> Entler's previous work was that made to Gene Henry who has <br /> experience with Entler's successful completion of force main <br /> sewage work. Pursuant to his affidavit, previously provided <br /> to the City Council , the work by Entler' s met his <br /> expectations and in fact he would hire Entler Excavating <br /> Company, Inc. again to perform force main sewage work. <br /> The glaring omission in the Engineering Department's <br /> communications to the City Council lies in the interview of <br /> Gene Henry, who was contacted by the Engineering Department. <br /> Gene Henry in fact was contacted by the Engineering Department <br /> after they claim to have determined to suggest rejection of <br /> the Entler Excavating bid, yet they did not amend the March <br /> 12th memo. <br /> Another inaccurate representation by the City Engineer is <br /> that interpretation of information provided by Mike Price of <br /> BGM. He indicated the ten year old Spring Creek water main <br /> work performed by Entler's for the City of Decatur itself, <br /> was still functioning satisfactorily. In fact, the Entler's <br /> work was inspected, accepted and paid for by our City. <br /> However, in the subjective interpretation by the Engineering <br /> Department, it was labeled "sub-standard.
