AGREEMENT II AGREEMENT made by and between the City of Decatur, Illinois, a municipal I corporation("City") and Soules Bird Repelent Company("Soules"). For and in consideration of the premises set out herein, the City and Soules agree as follows: 1. Soules shall provide bird repellent services to all properties owned by the City located within the boundaries set out in paragaph 2 hereof. Said services shall be those determined to be necessary in the sole discretion of Soules to eliminate the noisome and unsanitary accumulation of birds on City property; provided that, such services are in strict compliance with all applicable Federal, State and City statutes, ordinances, rules and regulations, including but not limited to environmental and conservation laws, and further provided that such services do not constitute a nuisance to abutting property owners or the public. 2. The area within which Soules shall provide bird repellent services, as discussed above, � is that area bounded by Cerro Gordo Street on the north, Franklin Street on the east, Wood Street on the south and Church Street on the west. 3. The bird repellent services to be provided by Soules, as required hereby, shall begin not later than October 1, 1996, and shall continue through September 30, 1999. 4. The City shall pay Soules for the services described herein at the following rates, and according to the following schedule, except as provided in paragraph 5 hereof: November 1, 1996 - $12,000, for the period October 1, 1996 - September 30, 1997 November 1, 1997 - $10,000, for the period October 1, 1997 - September 30, 1998 November l, 1998 - $10,000, for the period October 1, 1998 - September 30, 1999.
