AMENDMENT • . TO THE AGREEMENT FOR ENGINEERING SERVICES FOR THE CITY OF DECATUR REHABILITATION OF THE LOWER BROADWAY SEWER Dated October 16, 1995 Revise Paragraph 2 of The City Agrees to read as follows: Payment for all services for Items 4a through 4i,and Sa through Se rendered under the terms of this AGREEMENT sha11 be on a time and expense basis to be computed at the technical payroll cost to the ENGINEER times a multiplier of 2.0. Technical payroll cost is defined as the direct productive salary cost for time directly chargeable to the project, plus fringe benefits and payroll burden (includes sick leave, vacation and holiday pay, unemployment taxes, contribution for social security, workmen's compensation, insurance,retirement benefits and medical insurance benefits). Reimbursement of expenses and costs incurred specifically in fulfilling the terms of this AGREEMEIVT such as,but not limited to, outside professional services, stakes, blueprints, supplies,toll ca11s,transportation and subsistence shall be at the actual cost plus five(5)percent. The aggregate of all charges for the above work sha11 not exceed a maximum amount of $54,700.00. Revise Pazagraph 2 of It Is Mutually Agreed by adding the following paragraph: The provisions of this Section and the various rates of compensation for ENGINEER's services provided for in this AGREEMENT have been agreed to in anticipation of the orderly and continuous progress of the PROJECT. Contract completion for the construction phase shall be within 120 consecutive calendar days from the CTTY's Notice to Proceed to the Contractor. The ENGINEER shall not be responsible for any time delays in the PROJECT caused by circumstances beyond the ENGINEER's control. THE CTTY AND THE ENGINEER each binds himself, his partners, successors, executors, administrators and assignees to each other party hereto in respect to this AMENDMENT to the AGREEMFIVT dated October 16, 1995 and neither the CITY nor the ENGINEER shall assign,sublet or transfer any part of his interest in this AGREEMENT without the written consent of the other parly hereto.
