AMENDMENT • . <br /> TO THE <br /> AGREEMENT FOR ENGINEERING SERVICES <br /> FOR THE CITY OF DECATUR <br /> REHABILITATION OF THE LOWER BROADWAY SEWER <br /> Dated October 16, 1995 <br /> Revise Paragraph 2 of The City Agrees to read as follows: <br /> Payment for all services for Items 4a through 4i,and Sa through Se rendered under the terms of <br /> this AGREEMENT sha11 be on a time and expense basis to be computed at the technical payroll <br /> cost to the ENGINEER times a multiplier of 2.0. Technical payroll cost is defined as the direct <br /> productive salary cost for time directly chargeable to the project, plus fringe benefits and payroll <br /> burden (includes sick leave, vacation and holiday pay, unemployment taxes, contribution for <br /> social security, workmen's compensation, insurance,retirement benefits and medical insurance <br /> benefits). Reimbursement of expenses and costs incurred specifically in fulfilling the terms of <br /> this AGREEMEIVT such as,but not limited to, outside professional services, stakes, blueprints, <br /> supplies,toll ca11s,transportation and subsistence shall be at the actual cost plus five(5)percent. <br /> The aggregate of all charges for the above work sha11 not exceed a maximum amount of <br /> $54,700.00. <br /> Revise Pazagraph 2 of It Is Mutually Agreed by adding the following paragraph: <br /> The provisions of this Section and the various rates of compensation for ENGINEER's services <br /> provided for in this AGREEMENT have been agreed to in anticipation of the orderly and <br /> continuous progress of the PROJECT. Contract completion for the construction phase shall be <br /> within 120 consecutive calendar days from the CTTY's Notice to Proceed to the Contractor. <br /> The ENGINEER shall not be responsible for any time delays in the PROJECT caused by <br /> circumstances beyond the ENGINEER's control. <br /> THE CTTY AND THE ENGINEER each binds himself, his partners, successors, executors, <br /> administrators and assignees to each other party hereto in respect to this AMENDMENT to the <br /> AGREEMFIVT dated October 16, 1995 and neither the CITY nor the ENGINEER shall assign,sublet <br /> or transfer any part of his interest in this AGREEMENT without the written consent of the other parly <br /> hereto. <br /> IN WITNESS WI�REOF,the parties hereto have affixed their hands and seals this 19th day of <br /> August, 1996. <br /> C1TY OF DECATUR: ENGINEER: �" <br /> Bainbrid , Gee, ' anski&Associates,Inc. <br /> By <br /> Terry owley Charles N.
