2. The vehicles used in the Program shall be a wheelchair lift- I <br /> equipped van or a ramp-equipped van. <br /> 3. All CONTRACTOR'S drivers shall be properly licensed and shall <br /> meet all necessary state requirements. <br /> 4. CONTRACTOR will pick up the vehicle trip sheet for each day <br /> when they come to the DPTS storage facility to get the van. <br /> 5. The CITY shall, at CITY own expense, defend all suits that may be <br /> brought against Contractor on account of, or in connection with, or <br /> by reason of any damage or injury to life, limb or property, <br /> *connected with, growing out of or caused by any act or omission <br /> to act of CONTRACTOR or any employee of CONTRACTOR in <br /> or about the operation of said vehicle, *hereunder and shall save <br /> and keep harmless CONTRACTOR from any and all damages, <br /> judgments, costs and expenses of every kind that my arise or result <br /> by reason of the negligence of CONTRACTOR or the employees <br /> of CONTRACTOR by reason of, growing out of, or connected <br /> with the operation of said program and the carrying out of the <br /> terms and provisions of this Agreement. <br /> 6. The operators provided for the Program shall be employees of <br /> CONTRACTOR. CONTRACTOR shall certify to the CITY for <br /> each operator that: <br /> a. CONTRACTOR has workers compensation coverage for <br /> the operator; <br /> b. The operator has passed a physical examination as specified <br /> by the CITY; <br /> c. The operator has passed a drug test as specified by the <br /> CITY; <br /> d. The operator has the necessary valid operator's license; <br /> e. The operator has never had his or her operator's license <br /> suspended; <br /> f. The operator has never been convicted of, or pleaded guilty <br /> to, a felony char�e; and <br /> g. CONTRACTOR has confirmed personal and professional <br /> references as given by the operator. <br /> 7. The operators so provided will be subject to CITY supervision and <br /> to applicable bulletins, rules and regulations established for the <br /> Decatur Public Transit System. Any violation of said bulletins or <br /> rules and regulations will be reported to CONTRACTOR and <br /> CONTRACTOR shall take disciplinary action as is appropriate and <br /> agreeable to the CITY. <br /> 3 <br />
