Excerpts from Plan Commission Meeting of June 2, 2016: <br /> Cal. No. 16-17 Petition of XERXES PROPERTIES LLC-2, to <br /> rezone property located at 1205, 1215 and 1235 <br /> EAST PERSHING ROAD from M-1 Intense <br /> Commercial/Light Industrial District and M-2 <br /> Heavy Industrial District to B-2 Commercial <br /> District. <br /> Ms. Stickle presented the recommendation of staff: <br /> The subject site located at the southeast corner of East Pershing Road and North Jasper Street is <br /> currently zoned both M-1 Intense Commercial/Light Industrial District and M-2 Heavy Industrial <br /> District and consists of approximately 3.31 acres. <br /> The site has a small commercial structure, a two story multi-family residential structure, two <br /> accessory structures as well as parking areas to serve the structures. <br /> The petitioner proposes to rezone from M-1 Intense Commercial/Light Industrial District and M- <br /> 2 Heavy Industrial District to B-2 Commercial District that would allow for all those uses <br /> permitted in the B-2 District. <br /> Rezoning the site from M-1 Intense Commercial/Light Industrial District and M-2 Heavy <br /> Industrial District to B-2 Commercial District should not create any adverse effects on the <br /> adjacent properties or the City as a whole as the uses on the adjacent properties are compatible <br /> with the permitted uses of the B-2 Commercial District. <br /> The adjacent zoning includes M-1 Intense Commercial/Light Industrial to the north, east and <br /> west and M-2 Heavy Industrial District to the south. The adjacent land use to the north, south, <br /> east and west is commercial, there is also office use to the north. Although the B-2 Commercial <br /> District is not consistent with the intent of the Macon County and Decatur Comprehensive Plan <br /> which shows this area as Employment, Staff is of the opinion that this is a commercial corridor <br /> and B-2 zoning will allow for the highest and best use(s) of this site. The proposed zoning and <br /> permitted uses are compatible with the adjacent uses and zoning districts. <br /> Staff recommends approval of the rezoning. <br /> Section XXIX. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a <br /> public hearing on a rezoning request, and then forward its report and recommendation to the City <br /> Council for final approval. A motion to forward Calendar Number 16-17 to the City Council <br /> with a recommendation for approval is suggested. <br /> Mrs. Mary Cave stated the current site is two lots that are currently zoned both M-1 Intense <br /> Commercial/Light Industrial District and M-2 Heavy Industrial District. The petitioner would <br /> like to rezone to B-2 Commercial District for future development. <br /> There were no questions and no objectors present. <br /> It was moved and seconded (Harris/Frantz) to forward Calendar No. 16-17 to the City Council <br /> with a recommendation for approval. Motion carried unanimously. <br />
