c <br /> � . . <br /> DEVELOPMENT AGREEMENT <br /> This agreement is made and entered into by and between the City of Decatur, <br /> herein City, and First Site Development, LLC, herein First Site. <br /> Whereas, First Site has petitioned the City for a Planned Unit Development which was <br /> approved by an Ordinance Granting Special Permit Plan Unit Development For Land Bounded �'I <br /> By West Wood Street, South Oakland Avenue, West Decatur Street, and the Norfolk and <br /> Southern Railroad which was presented, passed, approved, and recorded by the City Council of <br /> the City of Decatur on December 18, 1995; <br /> Whereas, the parties hereto are hereby setting forth their agreement regarding certain <br /> incentives offered by the City for the project described by the above Planned Unit Development; <br /> It is therefore agreed to as followed: <br /> 1. For the area within the aforedescribed planned unit development, the City hereby <br /> I <br /> agrees that First Site and its affiliates, its general contractor, and the material suppliers shall <br /> have and receive the full benefits of the Enterprise Zone of the City in regard to the construction `I <br /> and use of said premises as provided for newly developed properties in said Enterprise Zone. <br /> 2. The City agrees to vacate all streets and alleys contained within the aforedescribed <br /> planned unit development, subject to an agreement with Millikin University and the City <br /> regarding compensation for the vacated area. <br /> 3. The City agrees to vacate all existing public utility easements located within the � <br /> interior of the aforedescribed planned unit development upon the condition that appropriate <br /> 1 <br />
