COlIlV1iJIVITY DEVELOPMENT MEMORANDUM
NO. 96-71
Apri124, 1996
TO: Honorable Mayor Terry M. Howley and City Council Members
FROM: Daniel R. Summerfeldt, City Manager
George C. Weaver, Director of Community Development
William B. Turner, Building Inspections Supervisor
SUBJECT: Appeal of decision of the City of Decatur Electrical Commission concerning the
denial of license of Richard C. Engdale
On April 11, 1996, the City of Decatur Electrical Commission met at the scheduled meeting and
voted on the request of two (2) individuals to grant their electrical licenses, although both had
submitted their application past the deadline for submission. Both requests were denied in
accordance with the provisions of City of Decatur Code Chapter 25, Section 8 and past practices.
The license expires on the last day of December of the calendar yeaz. A grace period until the
first day of February is granted by the Code.Notices for renewal are sent to each license holder
approxirnately 15 days prior to the expiration.
Section 9 of Chapter 25 establishes an appeal procedure for decisions of the Electrical
Commission. A decision may be overturned by an affirmative vote of five (5)members of the
City Council.
The Commission felt although the insurance forms of Mr. Engdale were delayed, they were not
necessary for him to maintain his Electricians License. He could have submitted the application
for the Electricians License prior to February 1, and applied for the Electrical Contractors
License at a later time.
The Code allows the individuals to retake the written test based on their experience. If passed,
the license would then be issued.
