The failure of Employee to deliver the Security (or Securities) <br /> described herein, shall operate to terminate the option of Employee to obtain the creditable service <br /> described herein. Employee remains free to exercise one option, or both options, upon delivery of <br /> one described Security (bond) or both described Securities (bonds). <br /> 8. This Agreement, together with all items incorporated herein by reference, and the <br /> exhibit which is attached hereto, constitutes the entire and complete agreement between the parties <br /> hereto, and there e�cist no inducements, promises, terms, conditions, or obligations made or entered <br /> into by either the City or Employee which are not contained expressly herein. The parties agree that <br /> to the extent any statement, comment, or representation is made which lies outside of this <br /> Agreement, the other of them did not rely upon such in any manner or fashion whatsoever. The <br /> parties further agree that each has had the opportunity to utilize legal counsel of its own choosing, <br /> and has conducted investigation into the matters contained herein sufficient to satisfy said party <br /> fully. The parties further covenant and agree that neither of them enter into this Agreement under <br /> any duress, confusion, or misapprehension, but both parties agree that they fully understa.nd the <br /> terms hereof. <br /> This Agreement shall not be subject to amendment, alteration, or modification unless such <br /> proposed amendment, alteration, or modification is reduced to writing and signed by the parties to <br /> be charged with said alternation, modification, or amendment. The provision requiring any <br /> amendment, modification, or alteration hereto to be in writing shall not be subject to waiver in any <br /> event. . <br /> 9. This Agreement is entered into within the City of Decatur, County of Macon, State <br /> of Illinois, on the date first above-written, and said Agreement shall be subj ect to and interpreted and <br /> 4 <br />
