AGREEMENT <br /> �I <br /> Agreement made this ��,' j y` day of�J i,�-�'� � 1995, by and between the City of <br /> Decatur, Illinois, a municipal corporation, ("City") and Caterpillar Inc., a Delaware corporation, <br /> ("Caterpillar"). <br /> The City and Caterpillar hereby agree as follows: <br /> 1. The City shall reconstruct and improve the traffic signalization at the corner of North <br /> 27th Street and East Pershing Road, in the City of Decatur, as shown on E�ibit A hereto and in <br /> accordance with instructions to bidders, specifications, plans and drawings designated as City , <br /> Project 9518 dated June, 1995. <br /> 2. That City will initiate, carry out and complete the improvement as outlined in ' <br /> paragraph 1 above; and, without limiting the generality of the foregoing, will: <br /> a. Prepare the plans and specifications; <br /> b. Receive bids and award a contract; <br /> c. Furnish engineering and inspection during <br /> construction; <br /> d. Cause the improvement to be constructed according <br /> to the plans, specifications and contract; and <br /> e. Pay all contract costs. <br /> 3. Caterpillar shall reimburse the City for one-half (1/2) of the final cost of the work <br /> described in paragraph 1 hereof. The City shall bill Caterpillar not more frequently than monthly <br /> for its share of said cost, and Caterpillar shall remit payment to the City within thirty (30) days of <br /> the receipt of said bill. <br />
