r r • r <br /> Owner understands and acknowledges that Owner is the. <br /> recipient of the money and is responsible for the proper applica- <br /> tion of such money for rehabilitation purposes in accordance with <br /> the regulations of the Federal Government, and the City. <br /> Owner understands and agrees that the City does not <br /> guarantee and is not responsible for any work performed by eon- <br /> tractor, but that the City will use its best efforts to aid Owner <br /> in the legal and proper use of money received by Owner from the <br /> City for rehabilitation purposes, and that Owner is and remains <br /> responsible for the use of such money throughout the time the <br /> rehabilitation project is being performed. Owner will cooperate <br /> with the City to accomplish the purpose of the rehabilitation <br /> project for Owner. <br /> To the extent permitted by law, Owner shall indemnify and <br /> hold harmless, the City and its agents from and against all <br /> claims, damages, losses and expenses, including attorneys' fees <br /> arising out of or resulting from the rehabilitation work to be <br /> performed on property of Owner with funds received by Owner from <br /> the City, including negligent acts or omissions of the contractor <br /> performing the rehabilitation work, his agents, subcontractors <br /> and anyone directly or indirectly employed by any of them, and, <br /> losses attributable to bodily injury, or death, and, injury to or <br /> destruction to tangible property including the loss of use <br /> resulting therefrom in their performance o� the rehabilitation <br /> project for Owner. <br /> Owner releases the City from any liability arising out of <br /> the giving or failure to give directions or instructions or any <br /> action or lack of action by the City or its agents . <br /> The City is not obligated to pay Owner for any work which <br /> the City did not authorize. <br />' Owner agrees to solicit for rehabilitation work through com- <br /> petitive bids, and obtain a minimum of two (2) itemized bids . <br /> Owner will provide evidence of efforts to solicit bids from <br /> minority and women contractors . The City staff will review the <br /> bids and authorize the Owner to enter into a contract . <br /> Owner agrees not to permit or make changes to the DOWNTOWN <br /> Rental Rehabilitation work write-up without the prior written ap- <br /> proval of the City. Upon acceptance of the rehabilitation works, <br /> DHA m� provide qualified lower income tenants residing at the <br /> property a Certificated or Voucher of Family Participation under <br /> the Section 8 Existing Housing Assistance Program. <br /> Borrower, who owns the premises commonly known as <br /> , Decatur, Illinois (premises) <br /> shall maintain all units rehabilitated with DOWNTOWN funds as <br /> residential rental property which is to be leased to members of <br /> the public for residential purposes upon the terms and conditions <br /> stated in this Notice. <br />
