However, <br /> notwithstanding the foregoing, it is agreed and understood that the <br /> CITY may, at its sole option, modify or eliminate said insurance or <br /> any portion thereof provided that the EMPLOYEE is treated no <br /> differently than other management employees. <br /> SECTION FOURTEEN . Public Official Liability Insurance and <br /> Representation by Legal Counsel. The CITY may provide the EMPLOYEE <br /> with public official liability insurance in accordance with that <br /> provided for other officers of the CITY. In addition, if the <br /> EMPLOYEE is sued in any court for any cause of action, except for <br /> criminal, traffic, or misdemeanor offenses, arising from his <br /> actions or conduct as an employee of the CITY, the CITY shall <br /> select and pay for an attorney who shall provide a defense for said <br /> EMPLOYEE, unless the City Council determines that said EMPLOYEE was <br /> acting outside of the scope of his duties when engaged in the <br /> action or conduct which forms the basis of the suit. <br /> SECTION FIFTEEN . Other Insurance. The CITY shall pay the <br /> full cost (but in no event not more than $850.00) of providing the <br /> EMPLOYEE $300, 000.00 (Three Hundred Thousand Dollars) of individual <br /> term life insurance, in addition to any other insurance coverage <br /> provided herein but further provided that the EMPLOYEE is insurable . <br /> on a non-rated basis. <br /> SECTION SIXTEEN . Holidays. The EMPLOYEE shall receive the <br /> same paid holidays as are afforded to other CITY officials. <br /> -6- <br />
