• � , <br /> AGREEMENT <br /> This Agreement is entered into by and between the State of Illinois acting through its <br /> Department of Transportation, hereinafter referred to as the STATE, Macon County of the State <br /> of Illinois, hereinafter referred to as the COUNTY, and the City of Decatur of the State of <br /> Illinois, hereinafter referred to as the CITY. <br /> WITNESSETH <br /> WHEREAS,the parties hereto, in order to facilitate the free flow of traffic and insure <br /> safety to the motoring public, are desirous of construction of a five-lane cross section on C.H. 1 <br /> (Brush College Road) from Mound Road to Brennaman Avenue by constructing a portland <br /> cement concrete pavement 64' face-to-face of curb and gutter; storm sewers; drainage <br /> appurtenances; and intersection improvements at Rae's Bridge Road, Richland Community <br /> College Entrance, and Mound Road to include signals at Rae's Bridge Road and Mound Road <br /> and construction of a 41ane cross section on C.H. 1 (Brush College Road) from Illinois Route 48 <br /> to Mound Road to include a Portland Cement Concrete Pavement 52' face-to-face of curb and <br /> gutter, storm sewer, drainage appurtenance, and intersection improvements at Illinois Route 48 to <br /> be identified as COL7NTY Sections 90-00119-01-PV, 90-00119-00-02-PV and STATE Job <br /> Number C-95-060-94, both sections hereinafter referred to as the PROJECT, and <br /> WHEREAS, the parties hereto are desirous of said PROJECT in that same will be <br /> immediate benefit to the residents of the area and permanent in nature. <br /> NOW, THEREFORE, in consideration of the mutual covenants contained herein,the <br /> parties hereto agree as follows: <br /> 1) It is mutually agreed that the PROJECT will be designed, let and constructed in <br /> accordance with Motor Fuel Ta�c standards, policies and procedures. <br />, 2) The COUNTY agrees to make or cause to be made all surveys; prepare or cause to be <br /> prepared the plans, specifications, and estimates; let and award the contract; provide <br /> engineering inspection during construction; and cause the improvement to be constructed <br /> in accordance with the plans, specifications, and contract "subject to partial <br /> reimbursement from the STATE and CITY." <br /> 3) The COtINTY agrees to retain jurisdiction and maintenance of the completed PROJECT <br /> in its entirety. <br /> 4) The COIJNTY agrees to acquire all necessary right-of-way in accordance with Motor <br /> Fuel Tax Policy and Procedure prior to advertising the PROJECT for letting subject to <br /> partial reimbursement by the STATE and the CITY. <br /> 5) The parties hereto mutually agree that the estimated construction cost of the PROJECT is <br /> $6,236,000. The STATE also agrees to pay the lesser of the amounts below in addition to <br /> any other funds for 9.691ane miles: <br /> a) 50% of the cost of the PROJECT, excluding costs related to geometric <br /> improvements to the intersections of the PROJECT, or <br />
