� . , <br /> a ` <br /> , <br /> t • <br /> � < < . <br /> ,` .. <br /> the costs of such replacement of recycling containers; provided, however, the Contractor shall use its <br /> best efforts and all due diligence, without charge to the City of Decatur or any resident of the dwelling, <br /> to obtain new recycling containers from the manufacturer thereof under the manufacturer's warranty <br /> when a replacement recycling container is made necessary due to a cause which is, or reasonably could <br /> be, covered by such warranty, and if a new recycling container is obtained under such warranty no <br /> charge shall be made therefore to the City or any resident of a dwelling. <br /> 3.8. All recyclable placed at the collection point shall be owned by and the <br /> responsibility of the residents of the dwelling so placing such recyclables until collected by Contractor, <br /> at which time the recyclables shall become the property of the Contractor except as provided in <br /> Subsection 3.9. <br /> 3.9. The City may at its sole discretion, direct the Contractor to deliver t�e �11 <br /> recyclables, to a designated site within Macon County, for processing and marketing by the City or a <br /> firm other than the Contractor. Provided, however, that the City shall pay to Contractor a mileage fee <br /> of $1.50 per loaded mile for delivery to any location outside of the City of Decatur. In that event, <br /> ownership of such recyclables shall vest in the City at the time of collection thereof by the Contractor; <br /> the Contractor's liability for such recyclables shall terminate upon delivery to the designated site. <br /> SECTION IV <br /> MISSED COLLECTIONS; COMPLAINTS; SEVERE WEATHER; HOLIDAYS <br /> 4.1. Collector shall maintain an office and office staff during normal working days <br /> and hours adequate to receive and respond to calls and letters from residents of the City relative to <br /> missed collections, or other complaints concerning collection of recyclable materials.
