+ � , <br /> DEPARTMENT OF TRANSPORTATION <br /> FEDERAL TRANSIT ADMINISTRATION <br /> AGREEMENT <br /> PART II OF II - TERMS AND CONDITIONS <br /> Constituting part of the AGREEh1ENT pro�-iding Federal financial assistance under the <br /> Federal Transit Act, as amended, 49 U.S.C. app. §§ 1601 et se�.; Title 23 U.S.C. (Highways); <br /> the National Capital Transportation Act of 1969, as amended; or the Intermodal Surface <br /> Transportation Efficiency Act of 1991, Pub. L. No. 102-240, Dec. 18, 1991 <br /> Section 101. Definitions. As used in this Agreement: <br /> a. As�reement means an�� Grant A�reement or Cooperati��e Agreement. <br /> b. .��}�lication means the signed and dated proposal for Federal financial assistance, including <br /> an�� amendment thereto, �ti�ith all explanatory, supporting, and supplementary documents filed <br /> ���ith and accepted or appro�•ed by the Go��ernment (FTA) by or on behalf of the Recipient. <br /> i <br /> c. Appro�•al. Authorization, Concurrence. �'Vai��er means a conscious ��Titten act by an <br /> authorized official of the Go��ernment granting permission to the Recipient to perform or omit an <br /> action required pursuant to this Agreement, ���hich action may not be performed or omitted <br /> ���ithout such permission. An appro��al, authorization, concurrence, or���aiver permitting the <br /> performance or omission of a specific action does not constitute permission to perform or omit <br /> other similar actions unless such permission is clearly stated. Oral permission or interpretations <br /> ha�e no le�al force or effect. <br /> d. A�pr���ed Project Bud�et means the most recently dated statement, approved by the <br /> Go��ernment, of the estimated tota] cost of the Project or Program, the items to be deducted from <br /> such total in order to calculate the estimated i�'et Project Cost, the maximum amount of Federal <br /> assistance for ���hich the Recipient is currently eligible, the specific items (including <br /> contin�encies specified) for ���hich the total may be spent, and the estimated cost of each of such <br /> items. <br /> e. Federa] Transit Act. as amended, is the statutory designation of the former Urban Mass <br /> Transportation Act of 1964, as amended, 49 U.S.C. app. § 1601 note. Any reference in any la���, <br /> map, regulation, document, paper, or other record of the United States to the Urban Mass i <br /> Transportation Act of 1964, as amended, shall be deemed a reference to the Federal Transit Act, <br /> as amended. <br /> f. Federal Transit Administration is the statutory designation of the former Urban Mass <br /> Transportation Administration, 49 U.S.C. app. § 1601 note.
