.� , corporate limits of the City. <br /> 10 . In the event that the Town shall fail to pay the City <br /> for water furnished within forty-five (45) days of the date of <br /> the bill for the same a penalty of two percent (2%) for each <br /> period of thirty (30) days or part thereof that the amount of <br /> such bill remains due and unpaid shall be added to the amount <br /> thereof and shall be paid by the Town. <br /> 11 . In the event that restrictions upon the use of water, <br /> whether as to amount or type of use or otherwise, are established <br /> by the City for use of water furnished from the City water system <br /> during any period, the Town shall establish and enforce the same <br /> restrictions in a like manner for water furnished from the system <br /> of the Town during said period if the Town is using City water at <br /> that time pursuant to this Agreement. <br /> 12 . As is currently ordained as to all water services <br /> furnished water from the water system of the City by the <br /> provisions of Chapter 64 , sections 18 and 19 of the City Code, <br /> the City may terminate the furnishing of water to the Town for <br /> non-payment of water charges as in said sections so provided, or <br /> as the same may be amended from time to time. Except for <br /> non-payment of water charges, and except as may be otherwise <br /> provided by applicable law, termination shall not be available as <br /> a remedy to enforce the provisions of this agreement, but the <br /> parties hereto may resort to action for damages or other �� <br /> appropriate relief to enforce the same or to correct, or obtain �I', <br /> restitution for injury occasioned by, violation of the provisions <br /> 5 <br />
