Route 552, C.W. Route 30 and/or in the event restoration of said CITY <br /> rnads to approximately its equal conditian prior to said usage upon the <br /> reopening of F.A.S. Rvute 552, C.N. Route 30 to through traffic, the STATE is <br /> wi 11 i ng to share i n sais� �ddi ti o�t�l cas�s as nere�narteif s 4i pu i ated. <br /> i . The CITY agrees to furnish all labor and equipment necessary for the <br /> maintenance of the CITY roads during the closure for rehabilitation of <br /> F.A.S. Route 552, C.H. Route 30, by the STATE and for restoration of same <br /> to approximately its condition prior to said usage, subject to partial <br /> reimbursement as hereir�after stipulated. <br /> 2. It is mutually agreed by the parties hereto that the estimated cost <br /> of the more�than-normal maintenance and/or more than normal <br /> restoration to be performed hereunder is �6,800.00. <br /> 3. 7he STAT� agrees to reimburse the CITY for the actual costs of a11 <br /> material incurred by the CITY under this agreement subject to maximum <br /> reimbu rsem�nt o�F $6,800,00 <br /> 4. The extent of deterioration of said CITY roads that is attributable <br /> to the additiona] volume of traffic generated by the c1osure of <br /> F.A.S. Route 552, C.H. Route 30, shall be determined mutually by the <br /> 5TATE and the CITY, based upon joint field-condition inventaries at <br /> the time the con�rac� that �ncludes the rehabilitation of F.A.S. <br /> Route 552, C.H. Route 30, is awarded and subsequent to its opening to <br /> through traffic. <br /> 5. The STATE agrees to reimburse the CI7Y for costs incurred by the CITY <br /> under this agreement, upon satisfactory invoices for same, subject to <br /> the aforesaid maximum reimbursement of $6,800.00. <br /> 6. The CITY shall main�ain, for a minimum of 5 years after the <br /> completion of the Praject, adequate books, records, and supporting <br /> documents to verify the amounts, recipients, and uses of all <br /> disburse�nents of funds passing in cvnjunction with this Agreement. <br /> All books , records, and supporting documents related to the Project <br /> shall be available for review and audi� by the Auditor General or <br /> other State Audi.tors and the CITY agrees to cooperate fu11y with any <br /> audit conducted by ti�e Audjtor General , or other State Auditors and <br /> to provide full access to ai7 relevant materials. Failure tio <br /> maintain the books, records, and supporting documents required by <br /> this paragraph shall estab]ish a .presumption in favor of the State <br /> for the recovery of any funds paid by the State under this Agreement <br /> for which adequate books, records, and support9ng documentation are <br /> not available to suppor� their purported disbursement. <br /> _._... 44128.2 <br />
