CORPORATION CERTIFICATIONS CAPACITY TO CONTRACT . The Corporation certifies that, as in accordance with SeC,ion 11.1 of the iilinois Purch2sing Act (30 ILCS 505), no person ':_ who is entitled to receive individually more than 7 1/2 perc�nt of the,fotal distributable income of the C�rporation or,together . with his or her spouse or minor chifd, more than 15 percent in the aggregate of the total distributable income of the Corpora- � tion, is (a) an efected state official, a member of the general assembly, an appointed officer, a state employee; (b) an officer - or employee of the Illinois Building Authority or the Illinois State Toll Highway Authority;or{c) a spouse or minor child of any such enumerated person. . ,t RETENTION OF RECORDS � The Corporation shall maintain, for a minimum of 5 ye�rs aiterihe completion of the agreement, adequate books, - records and supporting documents to verify the amounts, recipients and uses of all disbursements of funds passing in . conjunction with the agreement;ihe agreement and all books, records and supporting documents related to the agreement i oo erate full wiih an audit vailab(e for review and audit b the Auditor General; and the Corporat on agrees to c p y y shall be a Y , , , n ral and to rovide full access to all relevant materials. DRUG FREE WORKPLACE The Corporation certifies that it will not engage in the uNawful manufacture,distribution, dispensation, possession or use . of a controlled substance in the periormance of the agreement. If the Corporation employs 25 or more peopfe and the agreement is tor$5,000 or more, the tollowing applies: The Corporation certifies and agrees that it will provide a drug free workplace by: (a) Publishing a statement: � (1) Notifying emptoyees that the unlawful manuf2cture,distrbution,dispensing, possession or use of a controlled substance,including cannabis, is prohbited in the Corporation's workplace. . (2) Specifying the actions that will be taken against employees for violations of such prohibition. - . (3) Notifying the employee that; as a condition oi empldyment for this agreement, the employee will: (A) abide by the terms oi the statement; and (B) notify the employer of any criminal drvg statute conviction for a violation occuning in the workplace no _ fater than five (5) days after such conviction. (b) Establishing a drug iree awareness program to inform employees about: (1) the dangers of drug abuse in ihe workplace; � (2) the Corporation's policy of maintaining a drug iree wor4cplace; (3) any available drug counseling, rehabilitation;and employee assistance programs; and (4) the penalties that may be imposed upon an employee for drug violations. (c) Providing a copy oi the statement required by subparagraph (a)to each employee engaged in ihe performance of the agreement and to post the statement in a prominent place in the workplace.
