Fa�lure to ma�nta�n the required � . <br /> conducted b the Auditor Ge e p <br /> Y . . <br /> books, records and supporting documents shall establish a presumption m favor of the State for the recovery of any funds <br /> paid by the State under the agreement for which adequate books, records and supporting documentation are not available � <br /> to support their purported disbursement. <br /> DRUG FREE WORKPLACE <br /> The Corporation certifies that it will not engage in the uNawful manufacture,distribution, dispensation, possession or use . <br /> of a controlled substance in the periormance of the agreement. <br /> If the Corporation employs 25 or more peopfe and the agreement is tor$5,000 or more, the tollowing applies: <br /> The Corporation certifies and agrees that it will provide a drug free workplace by: <br /> (a) Publishing a statement: � <br /> (1) Notifying emptoyees that the unlawful manuf2cture,distrbution,dispensing, possession or use of a controlled <br /> substance,including cannabis, is prohbited in the Corporation's workplace. . <br /> (2) Specifying the actions that will be taken against employees for violations of such prohibition. - <br /> . (3) Notifying the employee that; as a condition oi empldyment for this agreement, the employee will: <br /> (A) abide by the terms oi the statement; and <br /> (B) notify the employer of any criminal drvg statute conviction for a violation occuning in the workplace no _ <br /> fater than five (5) days after such conviction. <br /> (b) Establishing a drug iree awareness program to inform employees about: <br /> (1) the dangers of drug abuse in ihe workplace; � <br /> (2) the Corporation's policy of maintaining a drug iree wor4cplace; <br /> (3) any available drug counseling, rehabilitation;and employee assistance programs; and <br /> (4) the penalties that may be imposed upon an employee for drug violations. <br /> (c) Providing a copy oi the statement required by subparagraph (a)to each employee engaged in ihe performance of <br /> the agreement and to post the statement in a prominent place in the workplace. <br />
